A few notes -- First, the event descriptions are based on criminal complaints; in other words, they are law enforcement's version of what happened. Second, we are looking at only those cases where the defendant was charged ONLY with possession of marijuana, second offense (or greater). We are not including any case where there were other charges involved. Third, the criminal histories here are limited to those found in CCAP, the state's online court database.
District Attorney John Chisholm noted in an interview that the numbers of second possession marijuana cases issued in Milwaukee County has dropped dramatically over the years. He said his office generally does not charge second offense marijuana possession as a felony unless the offender has a previous felony or there is some other circumstance, such as having a gun when the marijuana is found. Evidence that drug distribution is involved also can influence a decision.
Chisholm and Deputy District Attorney Jeffrey Altenburg said the district attorney's office has carefully reviewed its track record in charging second possession cases.
"We work very hard not to charge someone with their first felony offense with a second possession" unless there is some indication of violence, Altenburg said.
Chisholm said if there was one felony charge he could eliminate from the statute books, it would be the second offense marijuana felony.
"I don't think it adds too much any more," he said.

30. 3600 block of N. Sherman Blvd. – Police stopped the 40-year-old African-American driver of a car that blew through a red traffic light red. Officer could faintly smell pot and saw a bottle of Visine, "which is known to be used in conjunction with smoking marijuana to ease the effects of 'red eyes.'" Police recovered 9.11 grams (0.32 grams). Circuit Judge Frederick Rosa ordered the defendant to pay $500, including costs. He previously was convicted of possession of a firearm by a felon, operating while revoked (thrice), felony manufacturing or delivering cocaine (five counts). and felony manufacturing or delivering cocaine. He also was convicted in several cases that are too old to have details included on the Wisconsin Circuit Court Access database.
29. 2600 block of W. Atkinson Ave. – Police followed up at a battery complaint at a grocery store the previous day. A security guard pointed out the 27-year-old African-American defendant as involved. Police conducted a field interview of the defendant and smelled marijuana. The guard said he saw in a store video the defendant in a hand-to-hand exchange. Police recovered 2.38 grams (0.084 ounces) of cannabis from the defendant's underwear. Circuit Judge David Swanson sentenced the defendant to 18 months probation and stayed a sentence of 10 months in the House of Correction. The defendant previously was convicted of felony possession of marijuana second offense or greater (three times) and misdemeanor possession of marijuana (twice).
28. 2800 block of W. Hampton Ave. – Police conducting a traffic stop recovered 20.94 grams (0.74 ounces) of fresh marijuana and found $724.16. Circuit Judge Janet Protasiewicz sentenced the 26-year-old African-American defendant to two years probation and stayed a sentence of one year in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana.
27. 2800 block of N. Teutonia – Police responded to a shotspotter report indicating gunfire in the area. Saw a Mercury nearly cause accident by failing to yield the right of way when turning left. Officers made traffic stop and the defendant verbally consented to search of passenger compartment for guns and drugs. Police recovered 11 corner cuts and an additional baggie from vest pocket during booking. No weights were given. Circuit Judge Janet Protasiewicz sentenced the 27-year-old African-American defendant to 18 months probation and stayed a sentence of six months in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana.
26. 2600 block of N. 38th St. – Police made a traffic stop for excessive window tint and a dark license plate cover. There was a strong odor of marijuana coming from the vehicle. Police recovered 72.05 grams (2.54 ounces). Circuit Judge Frederick C. Rosa sentenced the 44-year-old African-American man to 15 months probation, with 30 days in the House of Correction conditional time. Rosa stayed the House time, and made it available to use at the discretion of the probation agent. He also stayed a sentence of nine months in the House. The defendant previously was convicted of felony possession of cocaine with intent to deliver, misdemeanor possession of marijuana (twice), and misdemeanor carrying a concealed weapon.
25. 1800 block of W. Wright St. – Police made a traffic stop of a Toyota without a front plate and with a defective stop lamp. The 24-year-old African-American defendant was in the front passenger's seat. He began reaching into pockets and police yelled at him to remove his hands. The defendant continued to reach into his pockets and then into the passenger side of the car. An officer pulled a gun, worried that the defendant had a weapon. Police patted down the defendant and found 7.3 grams (0.26 ounces) of marijuana. Circuit Judge David Swanson sentenced the defendant to four months in the House of Correction, the sentence to be served concurrently in state prison with that resulting from another felony. The defendant previously had been convicted of misdemeanor resisting or obstruction an officer, felony trafficking a child, felony exposing genitals to a child, felony possession of marijuana second offense or greater, misdemeanor disorderly conduct, and felony possession of marijuana with intent to deliver.
24. 2300 block of N. 15th St. – Police answered a trouble with a person call. They saw numerous folks standing around a van who began walking away. Officers ordered them to stop, but the 26-year-old African-American defendant kept walking. He again was ordered to stop. Officers were within an arm's length of the defendant when they smelled marijuana. Police recovered 29.66 grams
(1.05 ounces). Circuit Judge Frederick Rosa sentenced the defendant to 120 days in the House of Correction. The defendant previously had been convicted of misdemeanor obstructing or resisting an officer, felony manufacturing or delivery of marijuana near a school, misdemeanor disorderly conduct, and misdemeanor bail jumping.
23. 1700 block of N. 27th St. – Police made a traffic stop of a car with no registration plates. They smelled cannabis, and found 21.35 grams and one MDMA pill. The 32-year-old African American defendant was sentenced by Circuit Judge David Swanson to 18 months probation and stayed a sentence of six months in the House of Correction. The defendant previously was convicted of felony possession of marijuana second offense or greater.
22. 700 block of W. Center St. – Police stopped a car that did not have license plates. They smelled marijuana and found 5.15 grams (0.18 ounces). The charge against the 25-year-old African-American defendant was reduced to misdemeanor possession of marijuana. Circuit Judge David Swanson sentenced the defendant to one year of probation and stayed a six-month term in the House of Correction. The defendant previously was convicted of misdemeanor resisting or obstructing an officer, misdemeanor operating while revoked (five times), misdemeanor criminal damage to property, misdemeanor possession of marijuana, misdemeanor theft, misdemeanor bail jumping (three counts in one case), misdemeanor bail jumping, misdemeanor bail jumping (two counts in one case), misdemeanor failure to report to the county jail, misdemeanor possession of marijuana, misdemeanor possession of drug paraphernalia, operating while intoxicated (second offense), misdemeanor theft, misdemeanor witness intimidation, and misdemeanor bail jumping.
21. 2100 block of N. 44th St. – Police saw a Toyota run a red light while traveling eastbound on W. North Avenue. It collided with another car. The Toyota continued southbound and officers pursued it until the driver stopped. The 23-year-old white defendant said he was not trying to flee, but drove away because he was scared. Police found 43.64 grams (1.54 ounces) of marijuana on the floor behind the front passenger seat and in a backpack. Circuit Judge Carl Ashley authorized a deferred prosecution agreement for the defendant, who met the agreement's requirements. The case was dismissed. The defendant previously was convicted of misdemeanor possession of marijuana and felony possession of marijuana second offense or greater.
20. 4500 block of W. Burleigh St. – A car crashed into a pole and house in the 3000 block of N. 46th St. Officers responded. The 26-year-old African-American defendant was standing outside the car and appeared to be in pain from the accident. The car was almost torn in two. Officers checked the car to make sure no one else inside. They saw Tupperware with pot inside and a backpack that smelled like pot. The total recovered was 624.28 grams (22.02 ounces). Circuit Judge Frederick Rosa allowed the defendant to enter into a deferred prosecution agreement. The defendant previously was convicted of misdemeanor possession of marijuana and misdemeanor disorderly conduct.
19. 5400 block of W. Fond du Lac Ave. – Police stopped a car because the license plate was not listed to any vehicle. A routine check showed the 24-year-old African-American man was on probation for two felony convictions. Police noted a strong odor of unburned marijuana and recovered 18.17 grams (0.64 oundes). The defendant had title to the car. A jury found him not guilty. The defendant was represented by attorney Nathan Francis Opland-Dobs. The defendant previously was convicted of two counts of felony manufacturing / delivery of heroin, felony possession of cocaine with intent to deliver, and felony possession of heroin with intent to deliver,
18. 2600 block of W. Atkinson Ave. – Police conducted a field interview of the defendant because he was loitering. When asked if he had narcotics, the 23-year-old African-American man admitted to having marijuana. Police recovered 5.03 grams (0.18 ounces). Circuit Judge David Swanson sentenced the man to 12 months probation. Swanson stayed a sentence of six months in the House of Correction. The defendant previously was convicted of possession of cocaine with intent to deliver and felony burglary.
17. 1200 block of W. Highland Ave. – A car with excessively tinted windows was parked at a BP gas station. Officers saw the 23-year-old African-American defendant leave the car and go inside the station. As officers pulled up to the car and activated their lights, the car fled. The officers approached the defendant to get information about the driver. As they did so, they smelled marijuana. The defendant said that he had been smoking and left a bag of "weed" inside the station. Police recovered 24.02 grams (0.85 ounces). Circuit Judge Janet Protasiewicz sentenced the man to 100 days in the House of Correction with credit for 100 days served. She also said the defendant's record would be eligible for expungement if he earned his high school equivalency degree and successfully completed his sentence. The defendant previously was convicted of misdemeanor obstructing an officer, felony bail jumping, and felony manufacturing or delivery of marijuana.
16. 2300 block of N. 10th St. – Police made a traffic stop for excessively tinted windows and spotted a a bag with marijuana in it on the floorboard of the passenger side. They recovered 15.61 grams (0.55 ounces). Circuit Judge Frederick Rosa allowed the 24-year-old African-American man to enter into a deferred prosecution agreement, which he successfully completed. Rosa dismissed the charge in July 2018. The defendant previously was convicted of misdemeanor possession of marijuana (twice).
15. 5600 block of W. Silver Spring Dr. – Police made a traffic stop for excessive window tint and smelled marijuana. They recovered 28.2 grams (one ounce). The 21-year-old African-American man was sentenced by Circuit Judge Frederick Rosa to 18 months probation. A nine-month term in the House of Correction was stayed. The defendant had no previous criminal record in Wisconsin, according to online court information.
14. 6500 block of N. 107th St. – Police preparing to serve a search warrant saw the defendant leave the house and get ina car. He was not wearing a seat belt. He drove away his speed hit 65 mph. on N. 107th near Fond du Lac Ave. As officers approached the car, they smelled fresh marijuana. The found a baggy with one gram of marijuana in it when they searched the car, and another 21.6 grams when they searched the house (a total of 0.8 ounces). The 29-year-old African-American defendant said the marijuana was for personal use. Circuit Judge Carolina Stark sentenced the man to 100 days in the House of Correction with credit for 87 days. The defendant was previously convicted of felony theft, misdemeanor bail jumping (twice), felony possession of marijuana second offense or greater, misdemeanor carrying a concealed weapon, and misdemeanor possession of marijuana.
13. 2200 block of N. 33rd St. – Officers saw car deviating outside travel lanes without signaling or fully changing lanes. When the car stopped, the high tail light did not work. The officers attempted a traffic stop at N. 30th St. and W. North Ave., but the car did not stop. When they activated their siren and lights, the driver made furtive gestures. The 24-year-old African-American defendant got out and "began screaming towards officers." One of the officers saw a green leafy substance on defendant's lap. "The defendant then stated that he had been smoking a blunt when the officers initiated the traffic stop" and that he swallowed it. Police recovered 0.19 grams (0.007 ounces). Circuit Judge Frederick Rosa dismissed the case against the man as part of a plea agreement that included another case. The defendant previously was convicted of misdemeanor receiving or concealing stolen property, felon in possession of a firearm, felony operating a vehicle without the owner's consent (twice), misdemeanor possession of marijuana (twice), and misdemeanor obstructing or resisting an officer.
12. 2700 block of W. Kilbourn Ave. – The 27-year-old African-American defendant, who was known to officers, was straddling a bicycle. He was standing with two women, holding something in his hands that they were "looking at intently." The defendant made a hand-to-hand transaction with one of the women. Officers approached and stopped him. "The defendant appeared overly nervous with his hands visibly shaking and looking around as if he was looking for an escape route." The officers smelled marijuana and spotted a large bulge in the left front picket of the defendant's sweatpants. The search recovered 11.62 grams (0.41 ounces) of marijuana. Circuit Judge David Swanson sentenced the man to two years probation with 60 days in the House of Correction with Huber privileges. Swanson stayed a sentence of one year imprisonment and one year of extended supervision. The defendant previously was convicted of disorderly conduct, misdemeanor bail jumping, misdemeanor carrying a concealed weapon, misdemeanor endangering safety by intoxicated use of a firearm, misdemeanor possession of marijuana, and misdemeanor criminal damage to property.
11. 3500 block of W. Juneau Ave. – Police conducted a traffic stop for excessive tint. The officer could smell marijuana. The 42-year-old African-American defendant said he just finished blunt and gave the blunt end to the officer. A search turned up 10.26 additional grams (0.36 ounces). Circuit Judge David Swanson sentenced the man to seven days in the House of Correction with credit for seven days served, and fined him $200. The defendant previously was convicted of armed robbery, possession of a firearm by a felon (twice), disorderly conduct, misdemeanor resisting or obstructing an officer as a habitual offender, misdemeanor disorderly conduct (twice), felony possession of marijuana second offense or greater, and possession of cocaine with intent to deliver.
10. S. 70th St. and W. Greenfield Ave., West Allis – Police made a traffic stop for which no reason was given in the complaint. They smelled marijuana and recovered 2.3 grams (0.08 grams) from the 24-year-old African-American male defendant. "When asked whether there would be anything else in the vehicle, the defendant stated 'just weed' but 'not a lot' and that it would be located on the front passenger seat. The defendant stated that he does not really smoke weed, because he is still on probation, bu that he was holding it until his probation was complete." A vehicle searched turned up 21.8 grams (0.77 ounces). The case was still open as of Sep. 20, 2018. The defendant previously was convicted of misdemeanor carrying a concealed weapon and misdemeanor possession of marijuana.
9. 2400 block of N. Sherman Blvd. – Police made a traffic stop of car with tail lights that did not work "during a period of darkness." It took the defendant a significant time to stop. Police smelled marijuana and recovered 16.5 grams (0.58 ounces). The 27-year-old African-American man was sentenced by Circuit Judge Thomas J. McAdams to six months in the House of Correction with Huber privileges for work and child care. The defendant previously was convicted of felony possession of marijuana second offense or greater, obstructing or resisting an officer, felony possession of marijuana with intent to deliver, felony child abuse, misdemeanor battery, and felony felon in possession of a firearm.
8. 2900 block of S. 13th Street – Police served a search warrant. No one was home when it was executed. Authorities found heroin, crack cocaine and non-prescription sleep aids sometimes used to dilute heroin. There also was a large, heat-sealed bag containing marijuana. In a bedroom there were three more heat-sealed bags of pot. One weighed 481.8 grams (17 ounces); the second weighed 479.9 grams (16.9 ounces); and the third weighed 44.4 grams (1.6 ounces). Authorities found on the smallest bag the fingerprint of the defendant, who was not the target of the raid. When he was questioned later, the 29-year-old African-American man said he sometimes smoked pot with the unidentified target of the raid. The defendant recalled one time when he removed a bag of marijuana from the oven and then smoked some of it. He said he believed that is how his fingerprint ended up on the bag. Circuit Judge Carolina Stark ordered the man to pay a $200 fine or perform 10 hours of community service. The defendant previously was convicted of felony theft, felony possession of marijuana with intent to deliver, and felony adjudged delinquent in possession of a firearm.
7. 900 block of N. 27th St. – Police responded to a man-with-a-gun complaints. Officers saw an African-American man matching the description enter a restaurant. They conducted a field interview. While speaking with the 35-year-old man, officers observed a baggie with marijuana in it "hanging outside the defendant's right sweater pocket." After police retrieved it, the defendant said he had more and removed a blunt from inside the brim of his hat. Police recovered 7.98 grams (0.28 ounces). Circuit Judge David Swanson sentenced the defendant to one year's probation and stayed a sentence of six months in the House of Correction. Wheeler previously was convicted of misdemeanor resisting or obstructing an officer, felony possession of marijuana second offense or greater, felony fleeing an officer resulting in bodily harm, felony possession of cocaine second offense or greater, misdemeanor operating under the influence second offense, and felony manufacture or delivery of cocaine.
6. 3400 block of W. Center St. – Police stopped a car for excessively tinted windows and a lack of a license plates. The officer smelled marijuana and the 25-year-old African-American defendant admitted that he had just smoked. Police recovered 13.24 grams (0.47 ounces). Circuit Judge David Swanson allowed the defendant to enter into a deferred prosecution agreement. The man met the conditions of that agreement and the charge was dismissed. The defendant previously was convicted of felony second offense possession of marijuana, felony bail jumping, (four times), misdemeanor possession of marijuana, and felony possession of marijuana with intent to deliver.
5. 5400 block of N. Green Bay Ave. – Two traffic officers patrolling at 2000 block of W. Sheridan Ave. saw a car with excessively tinted windows and conducted a traffic stop. As the officers approached, they smelled marijuana. A total of 13.67 grams (0.48 ounces) of marijuana was recovered. The 29-year-old African-American male defendant was arrested. Circuit Judge David Swanson allowed the defendant to enter into a deferred prosecution agreement. The man met the conditions of that agreement and the charge was dismissed. The defendant previously was convicted of misdemeanor possession of marijuana.
4. 1500 block of N. 35th St. – Milwaukee police and federal agents stopped the car driven by the 24-year-old African American defendant while responding to a "man-with-a-gun" call. There was a woman in the front passenger seat, and law enforcement found a loaded handgun beneath the woman. Officers noticed a marijuana smell coming from the defendant and an officer felt a lump in the defendant's pocket. Police recovered 18.34 grams (0.65 ounces) of marijuana. The charge was subsequently dismissed, but read in to a subsequent felony case filed against the defendant. His previously was convicted of misdemeanor disorderly conduct and misdemeanor possession of marijuana.
3. 500 block of W. Maple St. – The 36-year old African-American defendant was the victim in a shooting. A bag of marijuana was found at the scene, and the man admitted it was his. Police recovered 11.94 grams (o.42 ounces). The case has not been resolved.
2. 2300 block of N. 5th St. – Police approached a car that was angle-parked where it should have been parallel parked. The vehicle was obstructing traffic. As an officer approached, the 30-year-old African-American defendant left the car, leaving the door open. An officer ordered him to stop, but he already was running away. Police chased and caught him. They recovered 3.47 grams (0.12 ounces) of marijuana from the car's console and another 14.16 grams (0.5 ounces) "along the defendant's flight path." Circuit Judge Carl Ashley allowed the man to enter a deferred prosecution agreement. The man successfully completed it, and the charge was dismissed. The defendant previously was convicted of felony possession of marijuana second offense or greater, felony possession of marijuana with intent to deliver (twice), misdemeanor battery, misdemeanor disorderly conduct, and felony manufacturing or delivery of marijuana.
1. 2900 block of N. 21st St. – A search warrant was served at the address in the 2900 block of N. 21st St. Police recovered 23.68 grams of marijuana inside a tennis shoe, 0.95 grams from on top of a desk; 11.09 grams from a desk drawer; and 1.7 grams from under a bed. In an opening in a wall, police found box of 9 mm ammunition. "There were 35 cartridges remaining in a box of 50," the complaint said. The 43-year-old African-American defendant said he smoked marijuana daily. He also said "he did not sell drugs he would sell marijuana." Circuit Judge Janet Protasiewicz sentenced the man to 18 months probation and stayed an eight-month term in the House of Correction. The Wisconsin Circuit Court Access program does not show the defendant's previous conviction(s).
2016 cases
50. 900 block of W. Center St. – An officer saw a car at a gas station. The car's motor was running, it had illegally tinted windows and no plates. As police approached the defendant got out of the back of the car and started to walk away. When the police tried to tell him to stop, he tried to catch a quick ride in another car, but failed. He was detained for questioning. Officers saw a clear plastic bag containing suspected pot on rear driver's side seat next to where the African-American defendant had been sitting. They also found a a scale on rear seat armrest nest to where the 22-year-old defendant sat. When police searched the vehicle, they found a 9mm handgun between the driver's seat and front seat center console. More marijuana , including 15 corner cuts. They recovered a total of 37.82 grams (1.3 ounces). Circuit Judge Janet Protasiewicz sentenced the defendant to 9 months in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana (twice), felony bail jumping, felon in possession of a firearm, felony possession of marijuana second offense or greater, and misdemeanor carrying a concealed weapon (twice).
49. 4300 block of W. Capitol Dr. – Police on bike patrol saw a car parked at a gas pump. The car "did not have a gas pump affixed to its tank." The police rolled near it and smelled pot. An officer saw the 25-year-old African-American defendant, in a rear passenger seat, manipulating a brown cigar containing a green leafy substance. When the defendant saw the police, he stuffed his hands into his waistband. While police talked to the front seat passenger, the suspect shoved a bag with marijuana in it into his waistband. An officer saw a gun fall from the defendant's pants leg. Police recovered 7.83 grams (0.28 ounces) of marijuana and a .38 caliber semi-automatic. The defendant had a concealed carry permit. Circuit Judge Janet Protasiewicz sentenced the defendant to five days in the House of Correction with credit for five days served. The defendant previously was convicted of misdemeanor possession of marijuana.
48. 7000 block of N. Berwyn Ave., Glendale – Police served a search warrant and recovered 22 grams (0.78 ounces) of marijuana, 204 grams (7.2 ounces) of stems, 0.6 grams (0.02 ounces) of cocaine, and a rifle in a case. Circuit Judge Carl Ashley approved a deferred prosecution agreement for the 34-year-old white male defendant. The defendant fulfilled the agreement and the charge was dismissed. The defendant previously had been convicted of misdemeanor possession of marijuana.
47. 3800 block of W. Hampton Ave. – Police conducted field interview of 33-year-old African-American man. During a pat-down, police found 4.37 grams (0.15 ounces) of marijuana in four bags in defendant's pocket. Circuit Judge David Swanson sentenced the defendant to 23 days in the House of Correction, with credit for 23 days. The defendant previously was convicted of misdemeanor driving while intoxicated, first degree recklessly endangering safety, felony possession of a firearm by a felon, armed robbery, felony possession of cocaine second offense or greater, felony possession of marijuana second offense or greater, and felony manufacture / delivery of marijuana.
46. 4200 block of N. 47th St. – Police conducted a field interview of 29-year-old African-American man, who was in a car. Police smelled marijuana. The defendant quickly rolled up the window, and police asked him to step out of the car. When the defendant did, the police spotted a baggie of marijuana in a compartment on the driver's side door. 45. 3100 block of W. Fond du Lac Ave. – Traffic stop for unspecified reason. The officer smelled marijuana. There were three men in the car, and the 37-year-old African-American defendant was the driver. A search of one driver turned up 25 corner cuts of crack cocaine, and 1.3 grams (0.05 ounces) of marijuana was later found in his shoe. The second passenger had 2.5 grams of marijuana (0.09 ounces). Another 1.3 grams was found in the center cupholder and a 9 mm handgun was found in the center console. Circuit Judge David Swanson sentenced the defendant to nine months in the House of Correction with Huber privileges. The defendant previously was convicted of two counts of felony possession of a firearm and one misdemeanor count of possession of marijuana in a case being appealed; and of felonies in two cases that pre-date CCAP.
44. 2400 block of S. Chase Ave. – Bicycle officer saw parked car at a gas station and approached the vehicle. The 31-year-old white defendant was holding a clear plastic bag containing powder. A three-year-old child was in the back seat. The officer demanded the bag, which appeared to be cocaine. The defendant turned it over and admitted what it was. The officer noticed a strong smell of marijuana. A search of the car turned up a half-burned pot cigar in the front ashtray. Tests on the white powder were inconclusive for cocaine. The case against the defendant still is pending. He previously was convicted of misdemeanor prostitution, misdemeanor child neglect, misdemeanor disorderly conduct, misdemeanor obstructing / resisting an officer (thrice), misdemeanor possession of marijuana, felony felon in possession of a firearm, felony possession of marijuana with intent to deliver, felony robbery with the use of force, and felony fleeing an officer.
43. 2600 block of N. 19th St. – Police received aldermanic complaints of "subjects loitering in the street and narcotics dealing." They checked out a van parked there with two men standing outside it and one sitting inside. Police shined a light inside and saw a green leavy substance. Recovered 1.31 grams (0.05 ounces). The defendant, a 46-year-old African-American man, was sentenced by Circuit Judge Carolina Stark to five days in the House of Correction with credit for five days served. The defendant previously was convicted of felony eluding a police officer (twice), felony possession of cocaine second offense or greater, felony forgery, felony possession of marijuana with intent to deliver, misdemeanor retail theft, misdemeanor criminal damage to property, felony possession of marijuana second offense or greater, misdemeanor criminal damage to property, misdemeanor criminal trespass to a a dwelling, and misdemeanor battery. 42. 4300 block of W. Fond du Lac Ave. – An officer on bike patrol saw a car parked away from the pumps at a gas station (same one as in #10!). When he approached, he smelled fresh marijuana and recovered 2.19 grams 0.08 ounces) The 35-year-old African-American defendant was sentenced by Circuit Judge Carolina Stark to four days in the House of Correction with credit for four days served. The defendant previously was convicted of felon of possession of a firearm, misdemeanor receiving stolen property, two counts of manufacturing / delivery of cocaine, and felony possession with intent to deliver cocaine (twice).
41. 4400 block of N. 41st St. – An officer saw a car parked more than a foot away from the curb and, upon approach, smelled marijuana. When the officer pulled up next to the car, he could see the defendant, a 30-year-old African-American man, filling a brown cigar wrapper with suspected marijuana. The officer recovered several corner cuts of marijuana. There also was an open bottle of vodka on the passenger seat. Circuit Judge David Swanson sentenced the defendant to 31 days in the House of Correction, with credit for 31 days served. The defendant previously was convicted of felon in possession of a firearm, misdemeanor criminal damage to property, misdemeanor disorderly conduct, misdemeanor possession of marijuana, felony maufacturing / delivery of marijuana, and misdemeanor possession of marijuana.
40. 1700 block of S. Pine St., South Milwaukee – Police executing a search warrant found 143.3 grams (5.1 ounces) of marijuana, plus paraphernalia. The 33-year-old Hispanic defendant was sentenced by Circuit Court Judge Carolina Stark to nine months in the House of Correction. The defendant previously was convicted of felony possession of marijuana second offense or greater, three counts of misdemeanor possession of marijuana, misdemeanor possession of marijuana (three additional cases), misdemeanor possession of paraphernalia, and misdemeanor possession of a concealed weapon.
39. 3100 block of W. Villard Ave. – Police stopped a car driven by a 39-year-old African-American male for not having a front plate. An officer detected the strong odor of marijuana. Recovered 17.21 grams (0.61 ounces) and a 9 mm handgun under the front seat. Case dismissed on prosecutor's motion. The defendant previously was convicted of manufacture / distribution of cocaine (twice) and had convictions for unspecified crimes prior to the state's conversion to CCAP.
38. 2000 block of N. 40th St. – Officers responded to a ShotSpotter, an audio-based system that helps police respond to gunfire. The defendant, a 21-year-old African-American man, was standing in the street and fled. Police caught him. He had 10 corner cuts with 4.57 grams (0.16 ounces) of marijuana. Defense attorney Caitlin Hazard Firer argued police lacked probable cause and asked for dismissal of the charges. Circuit Judge Timothy Witkowiak granted the motion. The defendant previously was convicted of second degree reckless homicide, misdemeanor bail jumping, and disorderly conduct.
37. 9600 block of S. 20th St., Oak Creek – Police saw a car parked at a closed Mobil station at 2 a.m. The car eventually left and went to a Plot Travel Center. Another car pulled up and the driver of that car got into the first car. Another officer arrived and saw a Tupperware container containing marijuana on the back passenger-side floor. Police recovered 37.4 grams (1.3 ounces) of marijuana. The defendant, a 34-year-old white man, was granted a deferred prosecution agreement. Circuit Judge Carl Ashley dismissed the case when the defendant successfully met the terms of the agreement. The defendant, who lived Kansas, was previously convicted of misdemeanor disorderly conduct.felony theft as a repeater, misdemeanor possession of marijuana, misdemeanor resisting or obstructing an officer, felony bail jumping, and felony battery by a prisoner.
36. 2100 block of N. 38th St. – Police arrived to investigate a loitering complaint. One of the loiterers fled. Meanwhile, the officers saw the 39-year-old African-American male defendant sitting in a car nearby. The car was parked more than 12 inches from the curb. Police asked the defendant to join the five loiterers who had not fled; they were in front of a residence. The police confirmed with the Wisconsin Department of Transportation that the defendant owned the car. One officer asked Webb if they could search the vehicle and Webb said, "No, go ahead." Police got a hit from a K9. Officers found a black zippered bag behind a speaker. Inside the bag were four knotted sandwich bags containing marijuana. Police recovered 41.02 grams (1.4 ounces). Defense attorney Calvin R. Malone filed a motion to suppress. The district attorney's office then moved for dismissal, and Circuit Judge David Swanson granted the request. The defendant previously was convicted of possession of marijuana with intent to deliver and convictions in an 1994 case that pre-date the existing CCAP system.
35. 2700 W. Kilbourn Ave. – Police saw a 44-year-old African-American man sitting on a stoop directly under a "no loitering / no trespassing" sign. A wanted check showed he had several municipal warrants. A search turned up 11.61 grams (0.41 ounces) of marijuana. Circuit Judge David Swanson approved a deferred prosecution agreement. The defendant previously was convicted of misdemeanor theft, felony obtaining drugs through fraud, felony escape (twice), felony manufacturing / delivery of cocaine, felony possession of marijuana second offense or greater (twice), and felony possession of cocaine second offense or greater (twice).
34. 4200 block of W. Silver Spring Dr. – Police saw someone on the passenger side of a van that was parked at a Marathon gas station. The person made eye contact with one of the officers "and immediately began to dip his right shoulder and move his arm downward toward his waist in a series of quick and rapid movements." One officer got off his bike and approached the van, gun drawn. He ordered the defendant, a 26-year-old African-American man, to show his hands. The defendant refused, so the officer opened the van door. He smelled marijuana. The defendant said he did not obey commands because he had a blunt. The defendant, who seemed very nervous, was handcuffed and detained. The driver also was removed from the van, but was not cuffed. "At this time, another vehicle that was not involved in this incident ran over (an officer's) bicycle, which was flat on the pavement in the gas station parking lot. This collision caused both officers to become temporarily distracted, and the driver ran back to the vehicle, and drove away." Police searched the defendant, and found a softball-sized bag "positioned in between the defendant's underwear and pants, just below the belt line." Defense attorney Darryl Everett Smith filed a motion to suppress the results of the search, which Circuit Judge David Swanson granted. The prosecutor then moved to dismiss the case, which the judge also granted. The defendant previously was convicted of misdemeanor endangering safety by use of dangerous weapon with controlled substance, misdemeanor possession of marijuana.
33. 1600 block of N. Arlington Pl. – Police responded to a complaint of someone passed out in a vehicle. Officer smelled strong odor of marijuana. There vehicle's occupant, a 26-year-old African-American man, was in the back seat, did not respond to officers' questions, and had slurred speech. He repeatedly reached for a backpack on the floor. During a pat down, he was non-compliant and had to be cuffed. Police found a total of 31.35 grams (1.1 ounce) in his pocket and backpack. Circuit Judge Carl Ashley approved a deferred prosecution agreement for the defendant. The defendant previously was convicted of felony maintaining a drug trafficking place and misdemeanor possession of marijuana.
32. 400 block of E. Center St. – Police were called after the 34-year-old African-American defendant got in a fight with his girlfriend that her children had to stop. He then broke dishes and a window. Police found him about the 400 block of E. Center St., During a search and booking, they found 47.49 grams (1.7 ounces). Circuit Judge Timothy Witkowiak sentenced the man, who was on parole in Indiana for a cocaine offence, to 93 days in the House of Correction with credit for 93 days time served.
31. 2600 block of W. Greenfield Ave. – Car was stopped after rolling through several stop signs. Officer smelled marijuana. The total weight was 29.05 grams (1.02 ounces). The charge against the 21-year-old male defendant was reduced to misdemeanor possession of marijuana. The defendant was sentenced by Circuit Judge David L. Swanson to three days in the House of Correction with credit for three days served.
30. 2000 block of W. Center St. – Police made a traffic stop for reasons not specified. Police saw the 18-year-old African-American man move his right shoulder and move his body up and down. The officer detected the strong odor of fresh marijuana as he approached the car. Police removed the defendant from the car. Found 23.65 grams (0.83 ounces) of pot beneath the front passenger seat. The case is pending. The defendant previously was convicted of misdemeanor possession of marijuana. Another charge of misdemeanor possession of marijuana is pending.
29. 5300 block of N. 35th St. – The defendant's girlfriend told police the 34-year-old African-American defendant came to her house with a gun and threatened to burn her house down. She told police he was in his car across the street and that he sold drugs, which he kept in a red Arizona iced tea can. Police brought in a drug dog, who hit on the car. Police found a false bottom in the can and recovered 6.9 grams (0.24 ounces). The defendant pleaded guilty and sentencing is pending. He previously was convicted of felony possession of a firearm by a felon (twice), felony possession of marijuana second offense or greater (twice), felony operating a vehicle without the owner's consent, felony bail jumping (twice), and felony manufacturing / delivery of cocaine.
28. 6800 block of W. North Ave., Wauwatosa – Police responded to a report of a person passed out in a car. The 30-year-old African-American man in the driver's seat failed to respond at first, but finally did so. He dropped a corner cut in the process. His passenger woke up and tried to pick up the corner cut and conceal it. Police recovered a total of 2.2 grams of pot (0.07 ounces). The defendant died before the court case was concluded. He previously was convicted of felony possession of marijuana second offense or greater (twice), driving after revocation (three times), misdemeanor possession of marijuana, and misdemeanor battery.
27. 2500 block of W. Melvina St. – Police saw a car with no plates and illegally tinted windows. The music was loud. The defendant, a 24-year-old African-American man who who was across the street, shook his car keys to show the car was his. He refused at first to come to the vehicle, the obeyed an order to unlock the car. An officer smelled marijuana and saw loose pot on the driver's side mat. The amount recovered was 1.82 grams (0.06 ounces). Circuit Judge Carolina Stark issued a $300 fine. The defendant previously was convicted of possession of a firearm by a felon, possession of cocaine with intent to deliver, and carrying a concealed weapon.
26. 2500 block of W. State St. – Bicycle officer saw three people huddled together in an alcove conducting what looked like hand-to-had transactions. When they saw the officer, the 30-year-old white male defendant and another man turned and explained that they were buying cigarettes, which is against city ordinance if done without a permit. A warrant check turned up a valid probation violation warrant. A search turned up 9.83 grams (0.35 ounces). Circuit Judge Carolina Stark sentenced the defendant to 140 days in the House of Correction and two years probation. Stark stayed a sentence of 12 months in the House. The defendant previously was convicted of felony identity theft, felony manufacture/deliver of marijuana, felony use of a child to manufacture or distribute a drug, and felony maintaining a drug trafficking place.
25. 3900 block of W. Clarke St. – Police stopped a car for excessive tint on the windows. An officer smelled marijuana. 0.64 grams (0.02 ounces). The charge against the 27-year-old African-American man was amended to misdemeanor possession of marijuana. Circuit Judge Carolina Stark sentenced the defendant to three days in the House of Correction with credit for three days served.
24. 6900 block of N. Teutonia Ave. – Police investigating a homicide went to a house, where they were allowed to enter and search. The found 8.67 grams (0.31 ounces) of marijuana. The 28-year-old African-American defendant admitted he sold marijuana around the apartment complex, but said this particular pot was for his personal use. The defendant was sentenced by Circuit Judge Daniel L. Konkol to 60 days in the House of Correction, consecutive to any other sentence. The defendant previously was convicted of misdemeanor possession of marijuana (twice), felony felon in possession of a firearm, felony escape, misdemeanor receiving stolen property, and felony operating a vehicle without the owner's consent.
23. 5400 block of W. Villard Ave. – Police stopped a car because the driver was not wearing a seat belt and a side window was illegally tinted. Officers smelled pot, and one officer thought he spotted loose marijuana in the car. Police found a baggie of pot in the 27-year-old African-American man's pocket and $4,124 in cash in the center console of the vehicle. Pot recovered weighted 87.5 grams (3.1 ounces). Circuit Judge David Swanson sentenced the defendant to one year of probation and stayed a sentence of one year in the House of Correction. The defendant previously was convicted of felony possession of marijuana and armed robbery with threat of force.
22. 3700 block of N. 35th St. – Police conducted a traffic stop of a car driven by a 30-year-old white woman. An officer smelled burning marijuana. Searched the car, and found a loaded black and silver Smith and Wesson .40 caliber handgun under the front seat. It was later discovered that it had been reported stolen two days earlier. 0.80 grams (0.03 ounces) of of marijuana was recovered. Circuit Judge Timothy Witkowiak sentenced the defendant to 134 days in the House of Correction with credit for 134 days served. The defendant previously was convicted of felony failure to pay child support, felony possession of marijuana second offense or greater, misdemeanor resisting or obstructing an officer (four times), misdemeanor retail theft, felony forgery (two counts), misdemeanor possession / illegally obtained prescription, and felony manufacturing / delivery of marijuana.
21. I-94 and 35th St., Milwaukee – A deputy pulled over a car driven by a 38-year-old African-American man after several lane deviations. The driver did not have a valid driver's license. An inventory search turned up a gym bag containing marijuana. The defendant said there was no more in the car, but "I have a few bags in my nuts." Marijuana totaled 62 grams (2.2 ounces). Circuit Judge Timothy Witkowiak fined the defendant $1,500. The defendant previously was convicted of felony possession of marijuana second offense or greater, felony possession of marijuana with intent to deliver, felony possession of cocaine with intent to deliver (twice), and misdemeanor resisting or obstructing an officer (twice).
20. 10900 block of W. Courtland Ave., Wauwatosa – Police stopped a car driven by a 40-year-old African-American man because he was driving the wrong way down Highway 100 (which was one-way due to construction). The officer smelled marijuana and searched the vehicle. Police found a bag, labelled "smelly proof," that contained marijuana. At the station, more marijuana was found in bags in the defendant's left shoe. The pot totaled 45.6 grams (1.6 ounces). Circuit Judge Carolina Stark sentenced the defendant to 18 months probation and stayed an eight month House of Correction sentence. Defendant previously was convicted twoice of possession of marijuana with intent to deliver, fleeing an officer, three counts of misdemeanor failure to support a child, felony possession of marijuana second offense or greater, felony tax stamp violation, felony possession of marijuana, and felony maintaining a drug place.
19. 9100 block of W. Silver Spring Dr. – Officer smelled fresh marijuana during a traffic stop of a 44-year-old African-American driver. Police found 0.8 grams (0.03 ounces). Sentenced by Circuit Judge David Swanson to 60 days in the House of Correction concurrent with parole / probation revocation. Defendant previously was convicted of felony possession of marijuana second offense or greater and felony manufacture / intent to deliver marijuana.
18. 5200 block of N. 62nd St. – Police stopped car carrying a 30-year-old African-American man for a seat belt violation. The officer immediately smelled burned marijuana and saw a cigarette in the middle console cup holder. Also saw a Hi-Point 9 mm gun, which was loaded. Recovered 14.4 grams (0.51 ounces) of marijuana. Sentenced by Circuit Judge Timothy Witkowiak to five months in the House of Correction, stayed; two years probation conditional on 10 days in the House with credit for three days served. Defendant previously was convicted twice of misdemeanor marijuana possession and once of misdemeanor disorderly conduct.
17. 2600 block of W. Fond du Lac Ave. – Traffic stop of a car because it had excessive window tint and the 27-year-old African-American man driving the car was not wearing a seat belt. Police smelled marijuana, and found a baggie with 3.3 grams 0.12 ounces). Defendant sentenced by Circuit Judge Carolina Stark to six days in the House of Correction with credit for three days served. The defendant previously was convicted of felony manufacturing / delivery of cocaine.
16. 900 block of S. Layton Blvd. – Traffic stop of car with suspended plates. Officers smelled marijuana and asked occupants to leave the car. A gallon-size baggie slid out from under the 20-year-old African-American male driver's thigh and fell to the ground. Recovered a total of 84.1 grams (three ounces). Sentenced by Circuit Judge Carolina Stark to six months in the House of Correction with credit for 71 days time served. Defendant previously was convicted of misdemeanor carrying a concealed weapon and felony possession with intent to deliver designer drugs.
15. 1600 block of S. 7th St. – Police smelled pot as they approached the car to interview a 24-year-old African-American man. They found three baggies containing marijuana, and another as the man was being booked, for a total of 28.46 grams (one ounce). Sentenced by Circuit Judge Janet Protasiewicz to 90 days in the House of Correction with Huber privileges. Defendant previously was convicted of felony possession of marijuana with intent to deliver, misdemeanor disorderly conduct and misdemeanor intimidating a victim or dissuading reporting.
14. 6400 block of W. Silver Spring Dr. – Police saw car with no plates. Hit squad lights and saw defendant, a 24-year-old African-American man, bend down. The car stopped. Police approached and smelled marijuana. Found 23.7 grams (0.84 ounces). Defendant also had $884 in cash. Sentenced by Circuit Judge Timothy Witkowiak to two years probation, with five days at the House. Sentence of one year at the House stayed. Defendant was previously convicted of possession of marijuana second offense or greater, misdemeanor possession of marijuana, and misdemeanor resisting or obstructing an officer.
13. 3200 block of N. 40th St. – Bike officers saw a car parked with running engine and lights on. Saw two open bottles of Miller beer in the back, one half full. Smelled marijuana. Saw a plastic grocery bag on the driver's side floorboard. It had Tupperware inside, which contained pot the size of a baseball. 22.95 grams (0.81 ounces). A 40-year-old African-American man was arrested. Circuit Judge Janet Protasiewicz sentenced him to four days in the House of Correction, time served. The defendant previously was charged with misdemeanor bail jumping, disorderly conduct (twice), possession of marijuana, resisting an officer, criminal trespass to dwelling, battery, and felony false imprisonment.
12. 4200 block of W. Auer Ave. – Officers saw a car with no front plate that failed to signal at a turn. They hit the squad lights and two baggies came "flying our of passenger side window while the vehicle took a block and a half to finally come to a stop." Total amount recovered was 29.75 grams (1.0 ounce). The 29-year-old African-American male defendant was sentenced by Circuit Judge Daniel F. Konkol to six months in the House of Correction, concurrent with prison sentence. Defendant previously was convicted of felony possession of marijuana second offense or greater and misdemeanor possession of marijuana.
11. 3300 block of N. 38th St. – Bike officers saw car, motor running, parked in an alley. Once they got near the car, they smelled marijuana and saw a 23-year-old African-American man smoking a blunt. A search of the car turned about more pot, a total of 2.49 grams (0.09 ounces). The officers also saw a tan substance they believed to be heroin in the driver's side door handle. The man said it was not his. Sentenced by Circuit Judge Timothy Witkowiak to two years probation. Sentence of seven months in the House of Correction stayed. Defendant previously was convicted of felon in possession of a firearm, felony driving a vehicle without the owner's consent, and possession of marijuana with intent to deliver.
10. 4300 block of W. Fond du Lac – Police saw an unoccupied car parked at a gas pump and a 24-year-old African-American man walking into the store. A bicycle officer rolls by and sees a plastic baggie of pot in the center console of the car. The car was searched and police found a total of 23.87 grams (0.84 ounces) of marijuana. Defense lawyer Danielle Louise Shelton filed a motion alleging illegal, stop, arrest and search. Circuit Judge Timothy M. Witkowiak dismissed the charge on the state's motion. The defendant previously was convicted of possession of marijuana second offense or greater, possession of marijuana with intent to deliver, and possession of narcotics.
9. 2100 block of N. 38th St. – Police saw three men playing dice. When one of the men, a 34-year-old African-American man saw the squad, he got up and started walking away, toward a car. When he reached it, he dropped something. It was a bag containing baggies of marijuana, a total of 9.38 grams (0.33 ounces). Placed on a deferred prosecution program by Circuit Judge Timothy Witkowiak; charged dismissed upon successful completion. Defendant was previously convicted of two charges felony possession of marijuana with intent to deliver; misdemeanor possession of marijuana and felony bail jumping; and felony cocaine possession with intent to deliver.
8. 4600 W. Capitol Dr. – Car driven by a 30-year-old African-American man passed a squad. The squad pulled behind the car and an officer observed the driver was clearly not wearing a seat belt. The officer activated the squad's lights, and it took two full city blocks for the subject car to pull over. The officer smelled fresh marijuana; found 3.13 grams (0.11 ounce) of fresh marijuana. Sentenced by Circuit Judge David Swanson on Aug. 19, 2016 to one year probation with multiple conditions. 180 days in House of Correction imposed and stayed. 90 days imposed and stayed for use a the discretion of the probation agent. In October, Swanson ordered the defendant to serve 90 days' straight time for violating the conditions of his probation. Defendant previously convicted four times of possession of marijuana second offense or greater and a variety of other crimes.
7. S. 60th St. and W. College Ave., Greendale – Police stopped a car driven by a 21-year-old Hispanic man. While no reason for the stop was given in the criminal complaint, another court document indicated he was stopped for not wearing a seat belt. Officers found four bags of marijuana totaling 31.2 grams (1.1 ounces) in backpack. "There was also apparent butane hash wax in there, as well," the complaint said. "It was quite a selection." Sentenced by Circuit Judge Carolina Stark to 90 days in the House of Correction, with credit for 90 days time served. Defendant previously convicted of possession with intent to deliver marijuana.
6. 5500 block of S. Packard Ave., Cudahy – Police stopped car driven by a 22-year-old Hispanic man because he was not wearing a seat belt. As the man exited the car, a digital scale fell to the ground. Police detected the strong odor of unburned marijuana. A search of the car turned up 14 grams (0.49 ounces) of marijuana in a Mason jar. The defendant also had an unloaded handgun in his car and a magazine of hollow-points in his front pocket. He previously was convicted of misdemeanor possession of marijuana.
5. I-43 and North Ave. – Milwaukee County Sheriff's deputies, responding to an accident, found a car driven by a 41-year-old African-American man facing the wrong way. The defendant eventually was arrested for operating while intoxicated. Deputy searched the car, and found 21 corner cuts containing a total of 21.8 grams (0.77 ounces). Sentenced by Circuit Judge Carolina Stark to one year probation with trauma-informed mental health evaluation recommended and absolute sobriety ordered. Stayed sentence of six months in the House of Correction with credit of four days time served. The defendant previously was convicted in two cases of felony possession of marijuana.
4: 2600 block of W. State St. – Police observe a 22-year-old African-American man get into a parked car and conducted a traffic stop because of a previous municipal traffic citation two days earlier. Officers said the man, seated in the driver's seat, had a "clenched fist" when they approached the car. They asked him to leave the car and he did not immediately comply. Police saw he had a paper cup with chicken wings in it on his lap. The man agreed to leave the car and put the cup of wings in the center armrest. The officers arrested him, put him in cuffs and then in the rear of their squad car. The police went back to the car, and looked in the cup under the chicken wings, where they found a plastic bag of marijuana. Defense lawyer Vincent Paul Guimont challenges the chicken wing search: "The officers simply saw a cup of chicken wings. The fact that the officer can see a cup of chicken wings does not provide probably cause to believe that contraband exists inside the car." Circuit Judge Carolina Stark dismisses the case on the prosecutor's motion. The defendant previously was convicted of a misdemeanor count of possession of THC.
3: 2100 block of N. 38th St. – Police stopped car driven by 23-year-old African-American man for unspecified reasons and smelled marijuana. Found four bags holding a total of 47.96 grams (1.69 ounces). Sentenced by Circuit Judge Timothy Witkowiak to 20 days in the House of Correction with credit for nine days served. Defendant previously was convicted of manufacturing with intent to deliver marijuana and possession with intent to deliver marijuana, both felonies. He was also convicted twice on misdemeanor counts of carrying a concealed weapon.
2: 3000 block of W. Locust St. – Police stopped the car for having no plates. Driver was 24-year-old African-American man. Police smelled pot and found 10.74 grams (0.38 ounces). Defendant had a concealed carry permit and a handgun, which turned out to be stolen. Sentenced by Circuit Judge Carolina Stark to two years probation. Stayed six months in the House of Correction with credit for three days time served. Eligible for expunction. Previously convicted of two misdemeanors, retail theft and possession of marijuana.
1: 2300 block of W. North Ave. – Traffic stop of a 23-year-old African-American male driver. Police said he ran a stop sign and his car's windows were heavily tinted. Defendant was searched, and police found 15.85 grams (0.56 ounces) of marijuana. Sentenced by Circuit Judge Timothy Witkowiak to 18 months probation and 100 hours of community services. Six months in the House of Correction was stayed. The defendant was previously convicted of two misdemeanors, marijuana possession and carrying a concealed weapon.
2015 Cases
45. 4200 block of W. Hadley St. – Police stopped a vehicle that failed to yield and almost hit a Milwaukee Police vehicle. Officers smelled marijuana and recovered 3.32 grams (0.12 ounces). Circuit Judge Carolina Stark sentenced the 40-year-old African-American male defendant to one year of probation and stayed a 60-day term in the House of Correction. It was the third time the defendant was convicted of felony possession of marijuana second offense or greater. The defendant also previously was convicted of felony possession of marijuana with intent to deliver (twice), misdemeanor possession of marijuana, and charges in three cases that date back to before implementation of the Wisconsin Circuit Court public courts database.
44. 6200 block of W. Fond du Lac Ave. – A sheriff's deputy stopped a vehicle because its rear plate was damaged and unreadable. The deputy smelled marijuana. A search ensued, and 4.89 grams (0.17 ounces) was recovered. The 36-year-old African-American defendant defendant was on parole for bank robbery at the time. The charge eventually was reduced to misdemeanor marijuana possession and Circuit Judge Timothy Witkowiak sentenced the man to pay court costs. 43. 5000 block of W. Villard Ave. – Police stopped a car driven by a 37-year-old African American many and found marijuana in the glove compartment. No reason for the stop is given in the complaint. Circuit Judge J.D. Watts sentenced the defendant to 41 days in the House of Correction, time served. Watts also suspended the defendant's driver's license for six months. 42. 3500 block of W. Villard Ave. – Police stopped a car with defective brake lights and suspended plates, smelled marijuana, and recovered 41.7 grams. The 23-year-old African American male defendant was sentenced by Circuit Judge Carolina Stark to two years probation. Stark stayed a sentence of two years in the House of Correction. The defendant also ignored police during the stop and looked instead at the passenger. Police smelled marijuana and recovered 15.08 grams (0.53 ounces). Circuit Judge J.D. 40. 2600 block of N. 14th St. – Police saw a man lean toward the driver's side door of a vehicle and complete what appeared to be a hand-to-transaction. As police approached the car, they smelled marijuana. There was a 34-year-old African-American defendant was seated on the driver's side of the car, and police recovered 8.04 grams (0.28 ounces) of marijuana from his right sock. Circuit Judge J.D. 37. 7400 block of W. Florist Ave. – A 23-year-old African-American man ran to police to say he had been shot at. Police conducted a consensual pat-down search and recovered 14.4 grams (0.51 ounces). 36. 2800 block of W. Lisbon Ave. – A vehicle was stopped at traffic lights with loud music playing. Police approached the car and smelled marijuana An officer saw the 24-year-old African-American man throw a baggie containing marijuana under the seat and saw a second baggie containing marijuana at the driver's feet. Circuit Judge Timothy Witkowiak sentenced the defendant to one year of probation and stayed a five-month term in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana, misdemeanor battery, and one felony before the launch of the public database, Wisconsin Court Court Access.
35. 900 block of N. 9th St. – County Jail staff smelled marijuana while they were booking a 25-year-old African-American man. They suspected it was on his body, as they could not find any in his clothes. In the medical section, the defendant stood up from his chair. A bag of marijuana was left where he had been seated, and the defendant admitted it was his. The marijuana weighed 3.67 grams (0.13 ounces). Circuit Judge Daniel L. Konkol sentenced the defendant to one year of probation and stayed a sentence of six months in the House of Correction. 34. 2200 block of N. 32nd St. – Police responded to a report of a stabbing. The defendant, a 40-year-old African-American man, was the victim. At first he told the police he was robbed and stabbed, then he told the police he accidentally stabbed himself during an argument with his girlfriend. He was taken to a hospital emergency room, where a nurse spotted a baggie with pot beneath his scrotum. Police recovered 4.28 grams (0.15 ounces). 32. 2400 block of N. 25th Street – The 50-year-old African-American man was arrested at his home in connection with a case involving recklessly endangering safety by use of a dangerous weapon. When he was searched, police found 9.87 grams (0.34 ounces) of marijuana. Circuit Judge Carolina Stark sentenced the defendant to one year's probation and stayed a sentence of 80 days in the House of Correction. 30. 3600 block of N. Sherman Blvd. – Police stopped the 40-year-old African-American driver of a car that blew through a red traffic light red. Officer could faintly smell pot and saw a bottle of Visine, "which is known to be used in conjunction with smoking marijuana to ease the effects of 'red eyes.'" Police recovered 9.11 grams (0.32 grams). Circuit Judge Frederick Rosa ordered the defendant to pay $500, including costs. He previously was convicted of possession of a firearm by a felon, operating while revoked (thrice), felony manufacturing or delivering cocaine (five counts). and felony manufacturing or delivering cocaine. 29. 2600 block of W. Atkinson Ave. – Police followed up at a battery complaint at a grocery store the previous day. A security guard pointed out the 27-year-old African-American defendant as involved. Police conducted a field interview of the defendant and smelled marijuana. The guard said he saw in a store video the defendant in a hand-to-hand exchange. Police recovered 2.38 grams (0.084 ounces) of cannabis from the defendant's underwear. 28. 2800 block of W. Hampton Ave. – Police conducting a traffic stop recovered 20.94 grams (0.74 ounces) of fresh marijuana and found $724.16. Circuit Judge Janet Protasiewicz sentenced the 26-year-old African-American defendant to two years probation and stayed a sentence of one year in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana.
27. 2800 block of N. Teutonia – Police responded to a shotspotter report indicating gunfire in the area. Saw a Mercury nearly cause accident by failing to yield the right of way when turning left. Officers made traffic stop and the defendant verbally consented to search of passenger compartment for guns and drugs. Police recovered 11 corner cuts and an additional baggie from vest pocket during booking. No weights were given. Circuit Judge Janet Protasiewicz sentenced the 27-year-old African-American defendant to 18 months probation and stayed a sentence of six months in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana.
26. 2600 block of N. 38th St. – Police made a traffic stop for excessive window tint and a dark license plate cover. There was a strong odor of marijuana coming from the vehicle. Police recovered 72.05 grams (2.54 ounces). Circuit Judge Frederick C. Rosa sentenced the 44-year-old African-American man to 15 months probation, with 30 days in the House of Correction conditional time. Rosa stayed the House time, and made it available to use at the discretion of the probation agent. He also stayed a sentence of nine months in the House. The defendant previously was convicted of felony possession of cocaine with intent to deliver, misdemeanor possession of marijuana (twice), and misdemeanor carrying a concealed weapon.
25. 1800 block of W. Wright St. – Police made a traffic stop of a Toyota without a front plate and with a defective stop lamp. The 24-year-old African-American defendant was in the front passenger's seat. He began reaching into pockets and police yelled at him to remove his hands. The defendant continued to reach into his pockets and then into the passenger side of the car. An officer pulled a gun, worried that the defendant had a weapon. Police patted down the defendant and found 7.3 grams (0.26 ounces) of marijuana. Circuit Judge David Swanson sentenced the defendant to four months in the House of Correction, the sentence to be served concurrently in state prison with that resulting from another felony. The defendant previously had been convicted of misdemeanor resisting or obstruction an officer, felony trafficking a child, felony exposing genitals to a child, felony possession of marijuana second offense or greater, misdemeanor disorderly conduct, and felony possession of marijuana with intent to deliver.
24. 2300 block of N. 15th St. – Police answered a trouble with a person call. They saw numerous folks standing around a van who began walking away. Officers ordered them to stop, but the 26-year-old African-American defendant kept walking. He again was ordered to stop. Officers were within an arm's length of the defendant when they smelled marijuana. Police recovered 29.66 grams
(1.05 ounces). Circuit Judge Frederick Rosa sentenced the defendant to 120 days in the House of Correction. 23. 1700 block of N. 27th St. – Police made a traffic stop of a car with no registration plates. They smelled cannabis, and found 21.35 grams and one MDMA pill. The 32-year-old African American defendant was sentenced by Circuit Judge David Swanson to 18 months probation and stayed a sentence of six months in the House of Correction. The defendant previously was convicted of felony possession of marijuana second offense or greater.
22. 700 block of W. Center St. – Police stopped a car that did not have license plates. They smelled marijuana and found 5.15 grams (0.18 ounces). The charge against the 25-year-old African-American defendant was reduced to misdemeanor possession of marijuana. Circuit Judge David Swanson sentenced the defendant to one year of probation and stayed a six-month term in the House of Correction. 21. 2100 block of N. 44th St. – Police saw a Toyota run a red light while traveling eastbound on W. North Avenue. It collided with another car. The Toyota continued southbound and officers pursued it until the driver stopped. The 23-year-old white defendant said he was not trying to flee, but drove away because he was scared. Police found 43.64 grams (1.54 ounces) of marijuana on the floor behind the front passenger seat and in a backpack. Circuit Judge Carl Ashley authorized a deferred prosecution agreement for the defendant, who met the agreement's requirements. The case was dismissed. The defendant previously was convicted of misdemeanor possession of marijuana and felony possession of marijuana second offense or greater.
20. 4500 block of W. Burleigh St. – A car crashed into a pole and house in the 3000 block of N. 46th St. Officers responded. The 26-year-old African-American defendant was standing outside the car and appeared to be in pain from the accident. The car was almost torn in two. Officers checked the car to make sure no one else inside. They saw Tupperware with pot inside and a backpack that smelled like pot. The total recovered was 624.28 grams (22.02 ounces). Circuit Judge Frederick Rosa allowed the defendant to enter into a deferred prosecution agreement. The defendant previously was convicted of misdemeanor possession of marijuana and misdemeanor disorderly conduct.
19. 5400 block of W. Fond du Lac Ave. – Police stopped a car because the license plate was not listed to any vehicle. A routine check showed the 24-year-old African-American man was on probation for two felony convictions. Police noted a strong odor of unburned marijuana and recovered 18.17 grams (0.64 oundes). The defendant had title to the car. A jury found him not guilty. The defendant was represented by attorney Nathan Francis Opland-Dobs. The defendant previously was convicted of two counts of felony manufacturing / delivery of heroin, felony possession of cocaine with intent to deliver, and felony possession of heroin with intent to deliver,
18. 2600 block of W. Atkinson Ave. – Police conducted a field interview of the defendant because he was loitering. When asked if he had narcotics, the 23-year-old African-American man admitted to having marijuana. Police recovered 5.03 grams (0.18 ounces). Circuit Judge David Swanson sentenced the man to 12 months probation. Swanson stayed a sentence of six months in the House of Correction. The defendant previously was convicted of possession of cocaine with intent to deliver and felony burglary.
17. 1200 block of W. Highland Ave. – A car with excessively tinted windows was parked at a BP gas station. Officers saw the 23-year-old African-American defendant leave the car and go inside the station. As officers pulled up to the car and activated their lights, the car fled. The officers approached the defendant to get information about the driver. As they did so, they smelled marijuana. The defendant said that he had been smoking and left a bag of "weed" inside the station. Police recovered 24.02 grams (0.85 ounces). Circuit Judge Janet Protasiewicz sentenced the man to 100 days in the House of Correction with credit for 100 days served. She also said the defendant's record would be eligible for expungement if he earned his high school equivalency degree and successfully completed his sentence. The defendant previously was convicted of misdemeanor obstructing an officer, felony bail jumping, and felony manufacturing or delivery of marijuana.
16. 2300 block of N. 10th St. – Police made a traffic stop for excessively tinted windows and spotted a a bag with marijuana in it on the floorboard of the passenger side. They recovered 15.61 grams (0.55 ounces). Circuit Judge Frederick Rosa allowed the 24-year-old African-American man to enter into a deferred prosecution agreement, which he successfully completed. Rosa dismissed the charge in July 2018. The defendant previously was convicted of misdemeanor possession of marijuana (twice).
15. 5600 block of W. Silver Spring Dr. – Police made a traffic stop for excessive window tint and smelled marijuana. They recovered 28.2 grams (one ounce). The 21-year-old African-American man was sentenced by Circuit Judge Frederick Rosa to 18 months probation. A nine-month term in the House of Correction was stayed. The defendant had no previous criminal record in Wisconsin, according to online court information.
14. 6500 block of N. 107th St. – Police preparing to serve a search warrant saw the defendant leave the house and get ina car. He was not wearing a seat belt. He drove away his speed hit 65 mph. on N. 107th near Fond du Lac Ave. As officers approached the car, they smelled fresh marijuana. The found a baggy with one gram of marijuana in it when they searched the car, and another 21.6 grams when they searched the house (a total of 0.8 ounces). The 29-year-old African-American defendant said the marijuana was for personal use. Circuit Judge Carolina Stark sentenced the man to 100 days in the House of Correction with credit for 87 days. The defendant was previously convicted of felony theft, misdemeanor bail jumping (twice), felony possession of marijuana second offense or greater, misdemeanor carrying a concealed weapon, and misdemeanor possession of marijuana.
13. 2200 block of N. 33rd St. – Officers saw car deviating outside travel lanes without signaling or fully changing lanes. When the car stopped, the high tail light did not work. The officers attempted a traffic stop at N. 30th St. and W. North Ave., but the car did not stop. When they activated their siren and lights, the driver made furtive gestures. The 24-year-old African-American defendant got out and "began screaming towards officers." One of the officers saw a green leafy substance on defendant's lap. "The defendant then stated that he had been smoking a blunt when the officers initiated the traffic stop" and that he swallowed it. Police recovered 0.19 grams (0.007 ounces). Circuit Judge Frederick Rosa dismissed the case against the man as part of a plea agreement that included another case. The defendant previously was convicted of misdemeanor receiving or concealing stolen property, felon in possession of a firearm, felony operating a vehicle without the owner's consent (twice), misdemeanor possession of marijuana (twice), and misdemeanor obstructing or resisting an officer.
12. 2700 block of W. Kilbourn Ave. – The 27-year-old African-American defendant, who was known to officers, was straddling a bicycle. He was standing with two women, holding something in his hands that they were "looking at intently." The defendant made a hand-to-hand transaction with one of the women. Officers approached and stopped him. "The defendant appeared overly nervous with his hands visibly shaking and looking around as if he was looking for an escape route." The officers smelled marijuana and spotted a large bulge in the left front picket of the defendant's sweatpants. The search recovered 11.62 grams (0.41 ounces) of marijuana. Circuit Judge David Swanson sentenced the man to two years probation with 60 days in the House of Correction with Huber privileges. Swanson stayed a sentence of one year imprisonment and one year of extended supervision. The defendant previously was convicted of disorderly conduct, misdemeanor bail jumping, misdemeanor carrying a concealed weapon, misdemeanor endangering safety by intoxicated use of a firearm, misdemeanor possession of marijuana, and misdemeanor criminal damage to property.
11. 3500 block of W. Juneau Ave. – Police conducted a traffic stop for excessive tint. The officer could smell marijuana. The 42-year-old African-American defendant said he just finished blunt and gave the blunt end to the officer. A search turned up 10.26 additional grams (0.36 ounces). Circuit Judge David Swanson sentenced the man to seven days in the House of Correction with credit for seven days served, and fined him $200. The defendant previously was convicted of armed robbery, possession of a firearm by a felon (twice), disorderly conduct, misdemeanor resisting or obstructing an officer as a habitual offender, misdemeanor disorderly conduct (twice), felony possession of marijuana second offense or greater, and possession of cocaine with intent to deliver.
10. S. 70th St. and W. Greenfield Ave., West Allis – Police made a traffic stop for which no reason was given in the complaint. They smelled marijuana and recovered 2.3 grams (0.08 grams) from the 24-year-old African-American male defendant. "When asked whether there would be anything else in the vehicle, the defendant stated 'just weed' but 'not a lot' and that it would be located on the front passenger seat. The defendant stated that he does not really smoke weed, because he is still on probation, bu that he was holding it until his probation was complete." A vehicle searched turned up 21.8 grams (0.77 ounces). The case was still open as of Sep. 20, 2018. The defendant previously was convicted of misdemeanor carrying a concealed weapon and misdemeanor possession of marijuana.
9. 2400 block of N. Sherman Blvd. – Police made a traffic stop of car with tail lights that did not work "during a period of darkness." It took the defendant a significant time to stop. Police smelled marijuana and recovered 16.5 grams (0.58 ounces). The 27-year-old African-American man was sentenced by Circuit Judge Thomas J. McAdams to six months in the House of Correction with Huber privileges for work and child care. The defendant previously was convicted of felony possession of marijuana second offense or greater, obstructing or resisting an officer, felony possession of marijuana with intent to deliver, felony child abuse, misdemeanor battery, and felony felon in possession of a firearm.
8. 2900 block of S. 13th Street – Police served a search warrant. No one was home when it was executed. Authorities found heroin, crack cocaine and non-prescription sleep aids sometimes used to dilute heroin. There also was a large, heat-sealed bag containing marijuana. In a bedroom there were three more heat-sealed bags of pot. One weighed 481.8 grams (17 ounces); the second weighed 479.9 grams (16.9 ounces); and the third weighed 44.4 grams (1.6 ounces). Authorities found on the smallest bag the fingerprint of the defendant, who was not the target of the raid. When he was questioned later, the 29-year-old African-American man said he sometimes smoked pot with the unidentified target of the raid. The defendant recalled one time when he removed a bag of marijuana from the oven and then smoked some of it. He said he believed that is how his fingerprint ended up on the bag. Circuit Judge Carolina Stark ordered the man to pay a $200 fine or perform 10 hours of community service. The defendant previously was convicted of felony theft, felony possession of marijuana with intent to deliver, and felony adjudged delinquent in possession of a firearm.
7. 900 block of N. 27th St. – Police responded to a man-with-a-gun complaints. Officers saw an African-American man matching the description enter a restaurant. They conducted a field interview. 6. 3400 block of W. Center St. – Police stopped a car for excessively tinted windows and a lack of a license plates. The officer smelled marijuana and the 25-year-old African-American defendant admitted that he had just smoked. Police recovered 13.24 grams (0.47 ounces). Circuit Judge David Swanson allowed the defendant to enter into a deferred prosecution agreement. The man met the conditions of that agreement and the charge was dismissed. 5. 5400 block of N. Green Bay Ave. – Two traffic officers patrolling at 2000 block of W. Sheridan Ave. saw a car with excessively tinted windows and conducted a traffic stop. As the officers approached, they smelled marijuana. A total of 13.67 grams (0.48 ounces) of marijuana was recovered. The 29-year-old African-American male defendant was arrested. Circuit Judge David Swanson allowed the defendant to enter into a deferred prosecution agreement. The man met the conditions of that agreement and the charge was dismissed. The defendant previously was convicted of misdemeanor possession of marijuana.
4. 1500 block of N. 35th St. – Milwaukee police and federal agents stopped the car driven by the 24-year-old African American defendant while responding to a "man-with-a-gun" call. There was a woman in the front passenger seat, and law enforcement found a loaded handgun beneath the woman. Officers noticed a marijuana smell coming from the defendant and an officer felt a lump in the defendant's pocket. Police recovered 18.34 grams (0.65 ounces) of marijuana. The charge was subsequently dismissed, but read in to a subsequent felony case filed against the defendant. His previously was convicted of misdemeanor disorderly conduct and misdemeanor possession of marijuana.
3. 500 block of W. Maple St. – The 36-year old African-American defendant was the victim in a shooting. A bag of marijuana was found at the scene, and the man admitted it was his. Police recovered 11.94 grams (o.42 ounces). The case has not been resolved.
2. 2300 block of N. 5th St. – Police approached a car that was angle-parked where it should have been parallel parked. The vehicle was obstructing traffic. As an officer approached, the 30-year-old African-American defendant left the car, leaving the door open. An officer ordered him to stop, but he already was running away. Police chased and caught him. They recovered 3.47 grams (0.12 ounces) of marijuana from the car's console and another 14.16 grams (0.5 ounces) "along the defendant's flight path." Circuit Judge Carl Ashley allowed the man to enter a deferred prosecution agreement. The man successfully completed it, and the charge was dismissed. The defendant previously was convicted of felony possession of marijuana second offense or greater, felony possession of marijuana with intent to deliver (twice), misdemeanor battery, misdemeanor disorderly conduct, and felony manufacturing or delivery of marijuana.
1. 2900 block of N. 21st St. – A search warrant was served at the address in the 2900 block of N. 21st St. Police recovered 23.68 grams of marijuana inside a tennis shoe, 0.95 grams from on top of a desk; 11.09 grams from a desk drawer; and 1.7 grams from under a bed. In an opening in a wall, police found box of 9 mm ammunition. "There were 35 cartridges remaining in a box of 50," the complaint said. The 43-year-old African-American defendant said he smoked marijuana daily. He also said "he did not sell drugs he would sell marijuana." Circuit Judge Janet Protasiewicz sentenced the man to 18 months probation and stayed an eight-month term in the House of Correction. 50. 900 block of W. Center St. – An officer saw a car at a gas station. The car's motor was running, it had illegally tinted windows and no plates. As police approached the defendant got out of the back of the car and started to walk away. When the police tried to tell him to stop, he tried to catch a quick ride in another car, but failed. He was detained for questioning. Officers saw a clear plastic bag containing suspected pot on rear driver's side seat next to where the African-American defendant had been sitting. They also found a a scale on rear seat armrest nest to where the 22-year-old defendant sat. When police searched the vehicle, they found a 9mm handgun between the driver's seat and front seat center console. More marijuana , including 15 corner cuts. They recovered a total of 37.82 grams (1.3 ounces). Circuit Judge Janet Protasiewicz sentenced the defendant to 9 months in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana (twice), felony bail jumping, felon in possession of a firearm, felony possession of marijuana second offense or greater, and misdemeanor carrying a concealed weapon (twice).
49. 4300 block of W. Capitol Dr. – Police on bike patrol saw a car parked at a gas pump. The car "did not have a gas pump affixed to its tank." The police rolled near it and smelled pot. An officer saw the 25-year-old African-American defendant, in a rear passenger seat, manipulating a brown cigar containing a green leafy substance. When the defendant saw the police, he stuffed his hands into his waistband. While police talked to the front seat passenger, the suspect shoved a bag with marijuana in it into his waistband. An officer saw a gun fall from the defendant's pants leg. Police recovered 7.83 grams (0.28 ounces) of marijuana and a .38 caliber semi-automatic. The defendant had a concealed carry permit. Circuit Judge Janet Protasiewicz sentenced the defendant to five days in the House of Correction with credit for five days served. The defendant previously was convicted of misdemeanor possession of marijuana.
48. 7000 block of N. Berwyn Ave., Glendale – Police served a search warrant and recovered 22 grams (0.78 ounces) of marijuana, 204 grams (7.2 ounces) of stems, 0.6 grams (0.02 ounces) of cocaine, and a rifle in a case. Circuit Judge Carl Ashley approved a deferred prosecution agreement for the 34-year-old white male defendant. The defendant fulfilled the agreement and the charge was dismissed. The defendant previously had been convicted of misdemeanor possession of marijuana.
47. 3800 block of W. Hampton Ave. – Police conducted field interview of 33-year-old African-American man. During a pat-down, police found 4.37 grams (0.15 ounces) of marijuana in four bags in defendant's pocket. Circuit Judge David Swanson sentenced the defendant to 23 days in the House of Correction, with credit for 23 days. The defendant previously was convicted of misdemeanor driving while intoxicated, first degree recklessly endangering safety, felony possession of a firearm by a felon, armed robbery, felony possession of cocaine second offense or greater, felony possession of marijuana second offense or greater, and felony manufacture / delivery of marijuana.
46. 4200 block of N. 47th St. – Police conducted a field interview of 29-year-old African-American man, who was in a car. Police smelled marijuana. The defendant quickly rolled up the window, and police asked him to step out of the car. When the defendant did, the police spotted a baggie of marijuana in a compartment on the driver's side door. Recovered 10.45 grams (0.37 ounces). Circuit Judge Timothy Witkowiak dismissed the charge at the state's request for reasons stated on the record, but not included in CCAP.
45. 3100 block of W. Fond du Lac Ave. – Traffic stop for unspecified reason. The officer smelled marijuana. There were three men in the car, and the 37-year-old African-American defendant was the driver. A search of one driver turned up 25 corner cuts of crack cocaine, and 1.3 grams (0.05 ounces) of marijuana was later found in his shoe. The second passenger had 2.5 grams of marijuana (0.09 ounces). Another 1.3 grams was found in the center cupholder and a 9 mm handgun was found in the center console. Circuit Judge David Swanson sentenced the defendant to nine months in the House of Correction with Huber privileges. The defendant previously was convicted of two counts of felony possession of a firearm and one misdemeanor count of possession of marijuana in a case being appealed; and of felonies in two cases that pre-date CCAP.
44. 2400 block of S. Chase Ave. – Bicycle officer saw parked car at a gas station and approached the vehicle. The 31-year-old white defendant was holding a clear plastic bag containing powder. A three-year-old child was in the back seat. The officer demanded the bag, which appeared to be cocaine. The defendant turned it over and admitted what it was. The officer noticed a strong smell of marijuana. A search of the car turned up a half-burned pot cigar in the front ashtray. Tests on the white powder were inconclusive for cocaine. The case against the defendant still is pending. He previously was convicted of misdemeanor prostitution, misdemeanor child neglect, misdemeanor disorderly conduct, misdemeanor obstructing / resisting an officer (thrice), misdemeanor possession of marijuana, felony felon in possession of a firearm, felony possession of marijuana with intent to deliver, felony robbery with the use of force, and felony fleeing an officer.
43. 2600 block of N. 19th St. – Police received aldermanic complaints of "subjects loitering in the street and narcotics dealing." They checked out a van parked there with two men standing outside it and one sitting inside. Police shined a light inside and saw a green leavy substance. Recovered 1.31 grams (0.05 ounces). The defendant, a 46-year-old African-American man, was sentenced by Circuit Judge Carolina Stark to five days in the House of Correction with credit for five days served. The defendant previously was convicted of felony eluding a police officer (twice), felony possession of cocaine second offense or greater, felony forgery, felony possession of marijuana with intent to deliver, misdemeanor retail theft, misdemeanor criminal damage to property, felony possession of marijuana second offense or greater, misdemeanor criminal damage to property, misdemeanor criminal trespass to a a dwelling, and misdemeanor battery. 42. 4300 block of W. Fond du Lac Ave. – An officer on bike patrol saw a car parked away from the pumps at a gas station (same one as in #10!). When he approached, he smelled fresh marijuana and recovered 2.19 grams 0.08 ounces) The 35-year-old African-American defendant was sentenced by Circuit Judge Carolina Stark to four days in the House of Correction with credit for four days served. The defendant previously was convicted of felon of possession of a firearm, misdemeanor receiving stolen property, two counts of manufacturing / delivery of cocaine, and felony possession with intent to deliver cocaine (twice).
41. 4400 block of N. 41st St. – An officer saw a car parked more than a foot away from the curb and, upon approach, smelled marijuana. When the officer pulled up next to the car, he could see the defendant, a 30-year-old African-American man, filling a brown cigar wrapper with suspected marijuana. The officer recovered several corner cuts of marijuana. There also was an open bottle of vodka on the passenger seat. Circuit Judge David Swanson sentenced the defendant to 31 days in the House of Correction, with credit for 31 days served. 40. 1700 block of S. Pine St., South Milwaukee – Police executing a search warrant found 143.3 grams (5.1 ounces) of marijuana, plus paraphernalia. The 33-year-old Hispanic defendant was sentenced by Circuit Court Judge Carolina Stark to nine months in the House of Correction. The defendant previously was convicted of felony possession of marijuana second offense or greater, three counts of misdemeanor possession of marijuana, misdemeanor possession of marijuana (three additional cases), misdemeanor possession of paraphernalia, and misdemeanor possession of a concealed weapon.
39. 3100 block of W. Villard Ave. – Police stopped a car driven by a 39-year-old African-American male for not having a front plate. An officer detected the strong odor of marijuana. Recovered 17.21 grams (0.61 ounces) and a 9 mm handgun under the front seat. Case dismissed on prosecutor's motion. The defendant previously was convicted of manufacture / distribution of cocaine (twice) and had convictions for unspecified crimes prior to the state's conversion to CCAP.
38. 2000 block of N. 40th St. – Officers responded to a ShotSpotter, an audio-based system that helps police respond to gunfire. The defendant, a 21-year-old African-American man, was standing in the street and fled. Police caught him. He had 10 corner cuts with 4.57 grams (0.16 ounces) of marijuana. Defense attorney Caitlin Hazard Firer argued police lacked probable cause and asked for dismissal of the charges. Circuit Judge Timothy Witkowiak granted the motion. The defendant previously was convicted of second degree reckless homicide, misdemeanor bail jumping, and disorderly conduct.
37. 9600 block of S. 20th St., Oak Creek – Police saw a car parked at a closed Mobil station at 2 a.m. The car eventually left and went to a Plot Travel Center. Another car pulled up and the driver of that car got into the first car. Another officer arrived and saw a Tupperware container containing marijuana on the back passenger-side floor. Police recovered 37.4 grams (1.3 ounces) of marijuana. The defendant, a 34-year-old white man, was granted a deferred prosecution agreement. Circuit Judge Carl Ashley dismissed the case when the defendant successfully met the terms of the agreement. The defendant, who lived Kansas, was previously convicted of misdemeanor disorderly conduct.felony theft as a repeater, misdemeanor possession of marijuana, misdemeanor resisting or obstructing an officer, felony bail jumping, and felony battery by a prisoner.
36. 2100 block of N. 38th St. – Police arrived to investigate a loitering complaint. One of the loiterers fled. Meanwhile, the officers saw the 39-year-old African-American male defendant sitting in a car nearby. The car was parked more than 12 inches from the curb. Police asked the defendant to join the five loiterers who had not fled; they were in front of a residence. The police confirmed with the Wisconsin Department of Transportation that the defendant owned the car. One officer asked Webb if they could search the vehicle and Webb said, "No, go ahead." Police got a hit from a K9. Officers found a black zippered bag behind a speaker. Inside the bag were four knotted sandwich bags containing marijuana. Police recovered 41.02 grams (1.4 ounces). Defense attorney Calvin R. Malone filed a motion to suppress. The district attorney's office then moved for dismissal, and Circuit Judge David Swanson granted the request. The defendant previously was convicted of possession of marijuana with intent to deliver and convictions in an 1994 case that pre-date the existing CCAP system.
35. 2700 W. Kilbourn Ave. – Police saw a 44-year-old African-American man sitting on a stoop directly under a "no loitering / no trespassing" sign. A wanted check showed he had several municipal warrants. A search turned up 11.61 grams (0.41 ounces) of marijuana. Circuit Judge David Swanson approved a deferred prosecution agreement. The defendant previously was convicted of misdemeanor theft, felony obtaining drugs through fraud, felony escape (twice), felony manufacturing / delivery of cocaine, felony possession of marijuana second offense or greater (twice), and felony possession of cocaine second offense or greater (twice).
34. 4200 block of W. Silver Spring Dr. – Police saw someone on the passenger side of a van that was parked at a Marathon gas station. The person made eye contact with one of the officers "and immediately began to dip his right shoulder and move his arm downward toward his waist in a series of quick and rapid movements." One officer got off his bike and approached the van, gun drawn. He ordered the defendant, a 26-year-old African-American man, to show his hands. The defendant refused, so the officer opened the van door. He smelled marijuana. The defendant said he did not obey commands because he had a blunt. The defendant, who seemed very nervous, was handcuffed and detained. The driver also was removed from the van, but was not cuffed. "At this time, another vehicle that was not involved in this incident ran over (an officer's) bicycle, which was flat on the pavement in the gas station parking lot. This collision caused both officers to become temporarily distracted, and the driver ran back to the vehicle, and drove away." Police searched the defendant, and found a softball-sized bag "positioned in between the defendant's underwear and pants, just below the belt line." Defense attorney Darryl Everett Smith filed a motion to suppress the results of the search, which Circuit Judge David Swanson granted. The prosecutor then moved to dismiss the case, which the judge also granted. The defendant previously was convicted of misdemeanor endangering safety by use of dangerous weapon with controlled substance, misdemeanor possession of marijuana.
33. 1600 block of N. Arlington Pl. – Police responded to a complaint of someone passed out in a vehicle. Officer smelled strong odor of marijuana. There vehicle's occupant, a 26-year-old African-American man, was in the back seat, did not respond to officers' questions, and had slurred speech. He repeatedly reached for a backpack on the floor. During a pat down, he was non-compliant and had to be cuffed. Police found a total of 31.35 grams (1.1 ounce) in his pocket and backpack. Circuit Judge Carl Ashley approved a deferred prosecution agreement for the defendant. The defendant previously was convicted of felony maintaining a drug trafficking place and misdemeanor possession of marijuana.
32. 400 block of E. Center St. – Police were called after the 34-year-old African-American defendant got in a fight with his girlfriend that her children had to stop. He then broke dishes and a window. Police found him about the 400 block of E. Center St., During a search and booking, they found 47.49 grams (1.7 ounces). Circuit Judge Timothy Witkowiak sentenced the man, who was on parole in Indiana for a cocaine offence, to 93 days in the House of Correction with credit for 93 days time served.
31. 2600 block of W. Greenfield Ave. – Car was stopped after rolling through several stop signs. Officer smelled marijuana. The total weight was 29.05 grams (1.02 ounces). The charge against the 21-year-old male defendant was reduced to misdemeanor possession of marijuana. The defendant was sentenced by Circuit Judge David L. Swanson to three days in the House of Correction with credit for three days served.
30. 2000 block of W. Center St. – Police made a traffic stop for reasons not specified. Police saw the 18-year-old African-American man move his right shoulder and move his body up and down. The officer detected the strong odor of fresh marijuana as he approached the car. Police removed the defendant from the car. Found 23.65 grams (0.83 ounces) of pot beneath the front passenger seat. The case is pending. The defendant previously was convicted of misdemeanor possession of marijuana. Another charge of misdemeanor possession of marijuana is pending.
29. 5300 block of N. 35th St. – The defendant's girlfriend told police the 34-year-old African-American defendant came to her house with a gun and threatened to burn her house down. She told police he was in his car across the street and that he sold drugs, which he kept in a red Arizona iced tea can. Police brought in a drug dog, who hit on the car. Police found a false bottom in the can and recovered 6.9 grams (0.24 ounces). The defendant pleaded guilty and sentencing is pending. He previously was convicted of felony possession of a firearm by a felon (twice), felony possession of marijuana second offense or greater (twice), felony operating a vehicle without the owner's consent, felony bail jumping (twice), and felony manufacturing / delivery of cocaine.
28. 6800 block of W. North Ave., Wauwatosa – Police responded to a report of a person passed out in a car. The 30-year-old African-American man in the driver's seat failed to respond at first, but finally did so. He dropped a corner cut in the process. His passenger woke up and tried to pick up the corner cut and conceal it. Police recovered a total of 2.2 grams of pot (0.07 ounces). The defendant died before the court case was concluded. He previously was convicted of felony possession of marijuana second offense or greater (twice), driving after revocation (three times), misdemeanor possession of marijuana, and misdemeanor battery.
27. 2500 block of W. Melvina St. – Police saw a car with no plates and illegally tinted windows. The music was loud. The defendant, a 24-year-old African-American man who who was across the street, shook his car keys to show the car was his. He refused at first to come to the vehicle, the obeyed an order to unlock the car. An officer smelled marijuana and saw loose pot on the driver's side mat. The amount recovered was 1.82 grams (0.06 ounces). Circuit Judge Carolina Stark issued a $300 fine. The defendant previously was convicted of possession of a firearm by a felon, possession of cocaine with intent to deliver, and carrying a concealed weapon.
26. 2500 block of W. State St. – Bicycle officer saw three people huddled together in an alcove conducting what looked like hand-to-had transactions. When they saw the officer, the 30-year-old white male defendant and another man turned and explained that they were buying cigarettes, which is against city ordinance if done without a permit. A warrant check turned up a valid probation violation warrant. A search turned up 9.83 grams (0.35 ounces). Circuit Judge Carolina Stark sentenced the defendant to 140 days in the House of Correction and two years probation. Stark stayed a sentence of 12 months in the House. The defendant previously was convicted of felony identity theft, felony manufacture/deliver of marijuana, felony use of a child to manufacture or distribute a drug, and felony maintaining a drug trafficking place.
25. 3900 block of W. Clarke St. – Police stopped a car for excessive tint on the windows. An officer smelled marijuana. 0.64 grams (0.02 ounces). The charge against the 27-year-old African-American man was amended to misdemeanor possession of marijuana. Circuit Judge Carolina Stark sentenced the defendant to three days in the House of Correction with credit for three days served.
24. 6900 block of N. Teutonia Ave. – Police investigating a homicide went to a house, where they were allowed to enter and search. The found 8.67 grams (0.31 ounces) of marijuana. The 28-year-old African-American defendant admitted he sold marijuana around the apartment complex, but said this particular pot was for his personal use. The defendant was sentenced by Circuit Judge Daniel L. Konkol to 60 days in the House of Correction, consecutive to any other sentence. The defendant previously was convicted of misdemeanor possession of marijuana (twice), felony felon in possession of a firearm, felony escape, misdemeanor receiving stolen property, and felony operating a vehicle without the owner's consent.
23. 5400 block of W. Villard Ave. – Police stopped a car because the driver was not wearing a seat belt and a side window was illegally tinted. Officers smelled pot, and one officer thought he spotted loose marijuana in the car. Police found a baggie of pot in the 27-year-old African-American man's pocket and $4,124 in cash in the center console of the vehicle. Pot recovered weighted 87.5 grams (3.1 ounces). Circuit Judge David Swanson sentenced the defendant to one year of probation and stayed a sentence of one year in the House of Correction. The defendant previously was convicted of felony possession of marijuana and armed robbery with threat of force.
22. 3700 block of N. 35th St. – Police conducted a traffic stop of a car driven by a 30-year-old white woman. An officer smelled burning marijuana. Searched the car, and found a loaded black and silver Smith and Wesson .40 caliber handgun under the front seat. It was later discovered that it had been reported stolen two days earlier. 0.80 grams (0.03 ounces) of of marijuana was recovered. Circuit Judge Timothy Witkowiak sentenced the defendant to 134 days in the House of Correction with credit for 134 days served. 21. I-94 and 35th St., Milwaukee – A deputy pulled over a car driven by a 38-year-old African-American man after several lane deviations. The driver did not have a valid driver's license. An inventory search turned up a gym bag containing marijuana. The defendant said there was no more in the car, but "I have a few bags in my nuts." Marijuana totaled 62 grams (2.2 ounces). Circuit Judge Timothy Witkowiak fined the defendant $1,500. The defendant previously was convicted of felony possession of marijuana second offense or greater, felony possession of marijuana with intent to deliver, felony possession of cocaine with intent to deliver (twice), and misdemeanor resisting or obstructing an officer (twice).
20. 10900 block of W. Courtland Ave., Wauwatosa – Police stopped a car driven by a 40-year-old African-American man because he was driving the wrong way down Highway 100 (which was one-way due to construction). The officer smelled marijuana and searched the vehicle. Police found a bag, labelled "smelly proof," that contained marijuana. At the station, more marijuana was found in bags in the defendant's left shoe. The pot totaled 45.6 grams (1.6 ounces). Circuit Judge Carolina Stark sentenced the defendant to 18 months probation and stayed an eight month House of Correction sentence. 19. 9100 block of W. Silver Spring Dr. – Officer smelled fresh marijuana during a traffic stop of a 44-year-old African-American driver. Police found 0.8 grams (0.03 ounces). Sentenced by Circuit Judge David Swanson to 60 days in the House of Correction concurrent with parole / probation revocation. Defendant previously was convicted of felony possession of marijuana second offense or greater and felony manufacture / intent to deliver marijuana.
18. 5200 block of N. 62nd St. – Police stopped car carrying a 30-year-old African-American man for a seat belt violation. The officer immediately smelled burned marijuana and saw a cigarette in the middle console cup holder. Also saw a Hi-Point 9 mm gun, which was loaded. Recovered 14.4 grams (0.51 ounces) of marijuana. Sentenced by Circuit Judge Timothy Witkowiak to five months in the House of Correction, stayed; two years probation conditional on 10 days in the House with credit for three days served. Defendant previously was convicted twice of misdemeanor marijuana possession and once of misdemeanor disorderly conduct.
17. 2600 block of W. Fond du Lac Ave. – Traffic stop of a car because it had excessive window tint and the 27-year-old African-American man driving the car was not wearing a seat belt. Police smelled marijuana, and found a baggie with 3.3 grams 0.12 ounces). Defendant sentenced by Circuit Judge Carolina Stark to six days in the House of Correction with credit for three days served. The defendant previously was convicted of felony manufacturing / delivery of cocaine.
16. 900 block of S. Layton Blvd. – Traffic stop of car with suspended plates. Officers smelled marijuana and asked occupants to leave the car. A gallon-size baggie slid out from under the 20-year-old African-American male driver's thigh and fell to the ground. Recovered a total of 84.1 grams (three ounces). Sentenced by Circuit Judge Carolina Stark to six months in the House of Correction with credit for 71 days time served. Defendant previously was convicted of misdemeanor carrying a concealed weapon and felony possession with intent to deliver designer drugs.
15. 1600 block of S. 7th St. – Police smelled pot as they approached the car to interview a 24-year-old African-American man. They found three baggies containing marijuana, and another as the man was being booked, for a total of 28.46 grams (one ounce). Sentenced by Circuit Judge Janet Protasiewicz to 90 days in the House of Correction with Huber privileges. Defendant previously was convicted of felony possession of marijuana with intent to deliver, misdemeanor disorderly conduct and misdemeanor intimidating a victim or dissuading reporting.
14. 6400 block of W. Silver Spring Dr. – Police saw car with no plates. Hit squad lights and saw defendant, a 24-year-old African-American man, bend down. The car stopped. Police approached and smelled marijuana. Found 23.7 grams (0.84 ounces). Defendant also had $884 in cash. Sentenced by Circuit Judge Timothy Witkowiak to two years probation, with five days at the House. Sentence of one year at the House stayed. Defendant was previously convicted of possession of marijuana second offense or greater, misdemeanor possession of marijuana, and misdemeanor resisting or obstructing an officer.
13. 3200 block of N. 40th St. – Bike officers saw a car parked with running engine and lights on. Saw two open bottles of Miller beer in the back, one half full. Smelled marijuana. Saw a plastic grocery bag on the driver's side floorboard. It had Tupperware inside, which contained pot the size of a baseball. 22.95 grams (0.81 ounces). A 40-year-old African-American man was arrested. Circuit Judge Janet Protasiewicz sentenced him to four days in the House of Correction, time served. The defendant previously was charged with misdemeanor bail jumping, disorderly conduct (twice), possession of marijuana, resisting an officer, criminal trespass to dwelling, battery, and felony false imprisonment.
12. 4200 block of W. Auer Ave. – Officers saw a car with no front plate that failed to signal at a turn. They hit the squad lights and two baggies came "flying our of passenger side window while the vehicle took a block and a half to finally come to a stop." Total amount recovered was 29.75 grams (1.0 ounce). The 29-year-old African-American male defendant was sentenced by Circuit Judge Daniel F. Konkol to six months in the House of Correction, concurrent with prison sentence. Defendant previously was convicted of felony possession of marijuana second offense or greater and misdemeanor possession of marijuana.
11. 3300 block of N. 38th St. – Bike officers saw car, motor running, parked in an alley. Once they got near the car, they smelled marijuana and saw a 23-year-old African-American man smoking a blunt. A search of the car turned about more pot, a total of 2.49 grams (0.09 ounces). The officers also saw a tan substance they believed to be heroin in the driver's side door handle. The man said it was not his. Sentenced by Circuit Judge Timothy Witkowiak to two years probation. Sentence of seven months in the House of Correction stayed. Defendant previously was convicted of felon in possession of a firearm, felony driving a vehicle without the owner's consent, and possession of marijuana with intent to deliver.
10. 4300 block of W. Fond du Lac – Police saw an unoccupied car parked at a gas pump and a 24-year-old African-American man walking into the store. A bicycle officer rolls by and sees a plastic baggie of pot in the center console of the car. The car was searched and police found a total of 23.87 grams (0.84 ounces) of marijuana. Defense lawyer Danielle Louise Shelton filed a motion alleging illegal, stop, arrest and search. Circuit Judge Timothy M. Witkowiak dismissed the charge on the state's motion. The defendant previously was convicted of possession of marijuana second offense or greater, possession of marijuana with intent to deliver, and possession of narcotics.
9. 2100 block of N. 38th St. – Police saw three men playing dice. When one of the men, a 34-year-old African-American man saw the squad, he got up and started walking away, toward a car. When he reached it, he dropped something. It was a bag containing baggies of marijuana, a total of 9.38 grams (0.33 ounces). Placed on a deferred prosecution program by Circuit Judge Timothy Witkowiak; charged dismissed upon successful completion. Defendant was previously convicted of two charges felony possession of marijuana with intent to deliver; misdemeanor possession of marijuana and felony bail jumping; and felony cocaine possession with intent to deliver.
8. 4600 W. Capitol Dr. – Car driven by a 30-year-old African-American man passed a squad. The squad pulled behind the car and an officer observed the driver was clearly not wearing a seat belt. The officer activated the squad's lights, and it took two full city blocks for the subject car to pull over. The officer smelled fresh marijuana; found 3.13 grams (0.11 ounce) of fresh marijuana. Sentenced by Circuit Judge David Swanson on Aug. 19, 2016 to one year probation with multiple conditions. 180 days in House of Correction imposed and stayed. 90 days imposed and stayed for use a the discretion of the probation agent. In October, Swanson ordered the defendant to serve 90 days' straight time for violating the conditions of his probation. Defendant previously convicted four times of possession of marijuana second offense or greater and a variety of other crimes.
7. S. 60th St. and W. College Ave., Greendale – Police stopped a car driven by a 21-year-old Hispanic man. While no reason for the stop was given in the criminal complaint, another court document indicated he was stopped for not wearing a seat belt. Officers found four bags of marijuana totaling 31.2 grams (1.1 ounces) in backpack. "There was also apparent butane hash wax in there, as well," the complaint said. "It was quite a selection." Sentenced by Circuit Judge Carolina Stark to 90 days in the House of Correction, with credit for 90 days time served. Defendant previously convicted of possession with intent to deliver marijuana.
6. 5500 block of S. Packard Ave., Cudahy – Police stopped car driven by a 22-year-old Hispanic man because he was not wearing a seat belt. As the man exited the car, a digital scale fell to the ground. Police detected the strong odor of unburned marijuana. A search of the car turned up 14 grams (0.49 ounces) of marijuana in a Mason jar. The defendant also had an unloaded handgun in his car and a magazine of hollow-points in his front pocket. He previously was convicted of misdemeanor possession of marijuana.
5. I-43 and North Ave. – Milwaukee County Sheriff's deputies, responding to an accident, found a car driven by a 41-year-old African-American man facing the wrong way. The defendant eventually was arrested for operating while intoxicated. Deputy searched the car, and found 21 corner cuts containing a total of 21.8 grams (0.77 ounces). Sentenced by Circuit Judge Carolina Stark to one year probation with trauma-informed mental health evaluation recommended and absolute sobriety ordered. Stayed sentence of six months in the House of Correction with credit of four days time served. The defendant previously was convicted in two cases of felony possession of marijuana.
4: 2600 block of W. State St. – Police observe a 22-year-old African-American man get into a parked car and conducted a traffic stop because of a previous municipal traffic citation two days earlier. Officers said the man, seated in the driver's seat, had a "clenched fist" when they approached the car. They asked him to leave the car and he did not immediately comply. Police saw he had a paper cup with chicken wings in it on his lap. The man agreed to leave the car and put the cup of wings in the center armrest. The officers arrested him, put him in cuffs and then in the rear of their squad car. The police went back to the car, and looked in the cup under the chicken wings, where they found a plastic bag of marijuana. Defense lawyer Vincent Paul Guimont challenges the chicken wing search: "The officers simply saw a cup of chicken wings. The fact that the officer can see a cup of chicken wings does not provide probably cause to believe that contraband exists inside the car." Circuit Judge Carolina Stark dismisses the case on the prosecutor's motion. The defendant previously was convicted of a misdemeanor count of possession of THC.
3: 2100 block of N. 38th St. – Police stopped car driven by 23-year-old African-American man for unspecified reasons and smelled marijuana. Found four bags holding a total of 47.96 grams (1.69 ounces). Sentenced by Circuit Judge Timothy Witkowiak to 20 days in the House of Correction with credit for nine days served. Defendant previously was convicted of manufacturing with intent to deliver marijuana and possession with intent to deliver marijuana, both felonies. He was also convicted twice on misdemeanor counts of carrying a concealed weapon.
2: 3000 block of W. Locust St. – Police stopped the car for having no plates. Driver was 24-year-old African-American man. Police smelled pot and found 10.74 grams (0.38 ounces). Defendant had a concealed carry permit and a handgun, which turned out to be stolen. Sentenced by Circuit Judge Carolina Stark to two years probation. Stayed six months in the House of Correction with credit for three days time served. Eligible for expunction. Previously convicted of two misdemeanors, retail theft and possession of marijuana.
1: 2300 block of W. North Ave. – Traffic stop of a 23-year-old African-American male driver. Police said he ran a stop sign and his car's windows were heavily tinted. Defendant was searched, and police found 15.85 grams (0.56 ounces) of marijuana. Sentenced by Circuit Judge Timothy Witkowiak to 18 months probation and 100 hours of community services. Six months in the House of Correction was stayed. The defendant was previously convicted of two misdemeanors, marijuana possession and carrying a concealed weapon.
2015 Cases
45. 4200 block of W. Hadley St. – Police stopped a vehicle that failed to yield and almost hit a Milwaukee Police vehicle. Officers smelled marijuana and recovered 3.32 grams (0.12 ounces). Circuit Judge Carolina Stark sentenced the 40-year-old African-American male defendant to one year of probation and stayed a 60-day term in the House of Correction. It was the third time the defendant was convicted of felony possession of marijuana second offense or greater. The defendant also previously was convicted of felony possession of marijuana with intent to deliver (twice), misdemeanor possession of marijuana, and charges in three cases that date back to before implementation of the Wisconsin Circuit Court public courts database.
44. 6200 block of W. Fond du Lac Ave. – A sheriff's deputy stopped a vehicle because its rear plate was damaged and unreadable. The deputy smelled marijuana. A search ensued, and 4.89 grams (0.17 ounces) was recovered. The 36-year-old African-American defendant defendant was on parole for bank robbery at the time. The charge eventually was reduced to misdemeanor marijuana possession and Circuit Judge Timothy Witkowiak sentenced the man to pay court costs. The defendant previously was convicted of felony second offense possession of marijuana, misdemeanor possession of marijuana (twice), and three counts of felony armed robbery.
43. 5000 block of W. Villard Ave. – Police stopped a car driven by a 37-year-old African American many and found marijuana in the glove compartment. No reason for the stop is given in the complaint. Circuit Judge J.D. Watts sentenced the defendant to 41 days in the House of Correction, time served. Watts also suspended the defendant's driver's license for six months. The defendant previously was convicted of felony delivery of cocaine as a repeater, felony possession of marijuana second offense or greater, felony manufacture / delivery of cocaine, an d felony operating a vehicle without the owner's consent.
42. 3500 block of W. Villard Ave. – Police stopped a car with defective brake lights and suspended plates, smelled marijuana, and recovered 41.7 grams. The 23-year-old African American male defendant was sentenced by Circuit Judge Carolina Stark to two years probation. Stark stayed a sentence of two years in the House of Correction. The defendant previously was convicted of misdemeanor obstructing or resisting an officer (twice), and felony possession of marijuana with intent to deliver.
41. 2300 block of N. 20th St. - Police stopped a vehicle driven by a 37-year-old African-American man because of the car had heavily tinted windows and because the license plate had expired. The defendant also ignored police during the stop and looked instead at the passenger. Police smelled marijuana and recovered 15.08 grams (0.53 ounces). Circuit Judge J.D. Watts sentenced the defendant to 90 days in the House of Correction, with credit for 45 days served. 40. 2600 block of N. 14th St. – Police saw a man lean toward the driver's side door of a vehicle and complete what appeared to be a hand-to-transaction. As police approached the car, they smelled marijuana. There was a 34-year-old African-American defendant was seated on the driver's side of the car, and police recovered 8.04 grams (0.28 ounces) of marijuana from his right sock. Circuit Judge J.D. 39. 3200 block of W. Lisbon Ave. – Police made a traffic stop of a car with illegally tinted windows. Officers smelled marijuana and recovered 2.84 grams (0.1 ounces). Circuit Judge Joseph M. Donald sentenced the 20-year-old African-American man to 37 days in the House of Correction, time served, and revoked his driver's license for six months. 38. 2800 block of N. 45th St. – Police stopped a car for an unexplained reason and saw the 31-year-old African-American man in possession of marijuana; 0.59 grams (0.02 ounces) were recovered. 37. 7400 block of W. Florist Ave. – A 23-year-old African-American man ran to police to say he had been shot at. Police conducted a consensual pat-down search and recovered 14.4 grams (0.51 ounces). Circuit Judge Carolina Stark sentenced the defendant to two days in the House of Correction, time served, The defendant previously was convicted of possession of marijuana with intent to deliver while armed with a dangerous weapon.
36. 2800 block of W. Lisbon Ave. – A vehicle was stopped at traffic lights with loud music playing. Police approached the car and smelled marijuana An officer saw the 24-year-old African-American man throw a baggie containing marijuana under the seat and saw a second baggie containing marijuana at the driver's feet. Circuit Judge Timothy Witkowiak sentenced the defendant to one year of probation and stayed a five-month term in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana, misdemeanor battery, and one felony before the launch of the public database, Wisconsin Court Court Access.
35. 900 block of N. 9th St. – County Jail staff smelled marijuana while they were booking a 25-year-old African-American man. They suspected it was on his body, as they could not find any in his clothes. In the medical section, the defendant stood up from his chair. A bag of marijuana was left where he had been seated, and the defendant admitted it was his. The marijuana weighed 3.67 grams (0.13 ounces). Circuit Judge Daniel L. Konkol sentenced the defendant to one year of probation and stayed a sentence of six months in the House of Correction. The defendant previously had been convicted of misdemeanor driving after revocation (twice), misdemeanor possession of marijuana, and felony possession of marijuana second offense or greater.
34. 2200 block of N. 32nd St. – Police responded to a report of a stabbing. The defendant, a 40-year-old African-American man, was the victim. At first he told the police he was robbed and stabbed, then he told the police he accidentally stabbed himself during an argument with his girlfriend. He was taken to a hospital emergency room, where a nurse spotted a baggie with pot beneath his scrotum. Police recovered 4.28 grams (0.15 ounces). Circuit Judge Carolina Stark sentenced the defendant to 120 days in the House of Correction. 33. 1900 block of W. Hampton Ave. – Police made a traffic stop of a car with a defective stop lamp. An officer smelled marijuana and police recovered 24.83 grams (0.88 ounces). They arrested a 25-year-old African-American man. Circuit Judge Carollina Stark sentenced the man to 15 days in the House of Correction. The defendant previously was convicted of misdemeanor possession of marijuana (twice), and felony armed robbery with use of force.
32. 2400 block of N. 25th Street – The 50-year-old African-American man was arrested at his home in connection with a case involving recklessly endangering safety by use of a dangerous weapon. When he was searched, police found 9.87 grams (0.34 ounces) of marijuana. Circuit Judge Carolina Stark sentenced the defendant to one year's probation and stayed a sentence of 80 days in the House of Correction. 31. 400 block of W. Clarke St. – Police responded to a complaint of suspected drug dealing. Police stopped the African-American suspect as he was leaving the building. He had four outstanding municipal court warrants. Police recovered 9.87 grams of marijuana (0.35 ounces). Circuit Judge Carolina Stark sentenced the 24-year-old defendant to 12 months probation and stayed a six-month term in the House of Correction. 30. 9000 block of W. Meinecke, Wauwatosa – Police ran the license plates of a car traveling westbound on W. North Ave. in Wauwatosa and learned that the plates were not registered to any vehicle. Police stopped the vehicle, which was driven by a 42-year-old African-American man. Police smelled marijuana and recovered 50.9 grams (1.8 ounces). Circuit Judge Carolina Stark sentenced the defendant to two years probation and stayed a sentence of one year in prison and one year of supervised release. 29. 200 block of W. Lincoln Ave – The 31-year-old white defendant was in a car accident. When police responded, he slurred his words. Police arrested him and, when they searched him later, found 0.9 grams of marijuana (0.03 ounces). The charge eventually was reduced to misdemeanor marijuana possession. Circuit Judge sentenced the defendant to 12 months probation and stayed a term of five months in the House of Correction. Watts also suspended his driver's license for six months. 28. 5400 block of N. Port Washington Rd., Glendale – During a routine motel check, police found that one of the registered guests was a 27-year-old African-American man with an outstanding warrant for violation of his supervision. He let police into his room and said he was ready to go. Police searched the bathroom and found 4.9 grams of marijuana (0.17 ounces). Circuit Judge Timothy Witkowiak sentenced the defendant to 60 days in the House of Correction, a time served disposition. The defendant previously was convicted of felony possession of marijuana second offense or greater, felony armed robbery with threat of force (twice), relony felon in possession of a firearm, misdemeanor possession of marijuana, and misdemeanor possession of cocaine.
27. 5500 block of W. Center St. – Police made a traffic stop of a car with expired plates, excessive window tint, and a cracked real tail light. An officer spotted marijuana in the car. A search turned up a total of 27.61 grams (0.97 ounces). The 51-year-old African-American man's two-year-old daughter was unrestrained in a back seat booster seat. Circuit Judge Carolina Stark sentenced the man to 18 months probation and stayed an eight-month term in the House of Correction. 26. 5500 block of N. 64th St. – Police made a traffic stop of a car with no plates and that did not have its headlights on. They detected the strong smell of marijuana and recovered 0.26 grams (.009 ounces). The 29-year-old African-American defendant was sentenced by Circuit Judge J.D. Watts to two days in the House of Correction, time served. Watts also informed the man that he was subject to deportation because he was not a citizen. The defendant previously was convicted of misdemeanor disorderly conduct, misdemeanor possession of marijuana (thrice), and felony driving a vehicle without the owner's consent.
25. 1100 block of N. 29th St. – Police made a traffic stop of a car that had potentially illegally tinted windows. The defendant eventually admitted smoking marijuana earlier in the day. Police found 8.6 grams (0.3 ounces) in his pocket and another 39.55 grams (1.4 ounces) in bags designed to block smells from escaping. They also found $832. Circuit Judge Daniel L. Konkol sentenced the 23-year-old African-American man to 18 months in prison followed by 24 months of extended supervision. The defendant previously was convicted of felony bail jumping, felony possession of marijuana second offense or greater, and felony possession of marijuana with intent to deliver.
24. 2000 block of N. 35th St. – Police making a traffic stop saw marijuana in the car and recovered .92 grams (0.03 ounces). Circuit Judge Carolina Stark sentenced the 40-year-old African-American man to 12 months probation and stayed a sentence of 40 days in the House of Correction. The defendant previously was convicted of felony bail jumping, felony intimidation of a witness, felony possession of a firearm by a felon, misdemeanor carrying a concealed weapon, misdemeanor operating while revoked (fourth offense), misdemeanor operating while revoked (third offense), misdemeanor disorderly conduct, misdemeanor criminal damage to property, and misdemeanor battery (two counts).
23. 1500 block of W. Center St. – Police made a traffic stop for an unspecified reason, smelled marijuana, and recovered 3.49 grams. (0.12 ounces). Circuit Judge Michael J. 22. 3800 block of N. 76th St. – Police observed that a car was blocking the street during what appeared to be a drug deal between the occupants of that car and a second car. Police followed the blocking car and saw its occupants were not wearing seat belts. Officers made the stop, then smelled fresh marijuana. The 25-year-old African-American male defendant said he had just smoked some and that he did not have any on him. A bit later, however, he pulled out a bag containing 3.62 grams (0.13 ounces). The charge was reduced to misdemeanor possession of marijuana. Circuit Judge Daniel L. Konkol sentenced the defendant to 66 days in the House of Correction. The defendant previously was convicted of felony felon in possession of a firearm (twice) and felony possession of marijuana with intent to deliver.
21. 4000 block of N. 51st St. – Police smelled marijuana after making a traffic stop for reasons not detailed in the complaint. They spotted plastic backs and turned up a total of 8.17 grams (0.29 ounces) of pot. Circuit Judge Michael J. Skwierawski sentenced the 25-year-old African-American defendant to 12 months probation and stayed a sentence of 10 days in the House of Correction. The defendant previously had been convicted of misdemeanor possession of marijuana (twice) and misdemeanor possession of cocaine.
20. 3300 block of N. Buffum – Police picked up the 27-year-old defendant for violation of supervision. He was searched, and 2.17 grams (0.08 ounces) of marijuana were recovered. Circuit Judge Michael Skwierawski sentenced the African-American defendant to 30 days in the House of Correction, concurrent with a previous sentence. The defendant previously was convicted of misdemeanor battery, felony possession of narcotic drugs, felony selling / possessing / manufacturing a molotov cocktail, and misdemeanor carrying a concealed weapon.
19. 1000 block of N. 10th St. – Police picked up the 26-year-old African-American defendant for violating his supervision and took him to the Milwaukee Secure Detention Facility. As he was changing from street clothes into prison garb, officers saw an object protruding from his buttocks. Several baggies fell from his rectal area. "The defendant placed the baggies into his mouth and tried to chew and swallow them," the complaint said. He spat some out, but apparently swallowed others. About 3.3 grams (0.12 ounces) were recovered. Circuit Judge J.D. Watts sentenced the defendant to five months in the House of Correction and suspended his driver's license for six months. The defendant previously was convicted of felony felon in possession of a firearm, felony falsely presenting a non-controlled substance, and robbery with threat of force.
18. 3000 block of N. 12th St. – Police smelled marijuana during a traffic stop, made for unspecified reasons, and recovered 1.59 grams (0.06 ounces). Circuit Judge Michael J. Skwierawski sentenced the 35-year-old African-American man to three days in the House of Correction, with credit for three days served, and ordered him to pay a fine of $1,000 or perform 50 hours of community service. 17. 100 block of W. Chambers St. – Police made a traffic stop for tinted windows. The driver had an outstanding warrant. During booking, police found 6.79 grams of marijuana. Circuit Judge J.D. Watts sentenced the 27-year-old African-American defendant to 90 days in the House of Correction. The defendant previously was convicted of felony second offense possession of marijuana, felony MDMA with intent to deliver, and misdemeanor carrying a concealed weapon.
